Day 4: Hearing Resumes
This morning, Senators will question Judge Alito during a third round. They will then go into a closed session, to review the FBI background investigation on the Supreme Court nominee. Outside witnesses may be called to testify this afternoon, as well as the American Bar Association, to discuss its recommendations.

He just needs to tell her that he hasn't had time to fully consider this. And that really she's asking him something that he might have to rule on. And that he's willing to listen to all arguments and make a fair and constitutional decision.

It's a legitimate debate - I'm of the opinion that it's Congress who has come short, and is now trying to deflect their shortcoming to the guy who took initiative. Until the facts come out (exactly what was the scope of warrantless surveillance?), this is nothing but posturing - preselling an outcome based on figments of imagination.
I've said it before, this skirmish over surveillance, between Congress and the President, can be settled without resort to the courts. We'll see if Congress is up to their duty.
DiFi is "litigating the case," but it's one-sided becuase the executive isn't there to rebut. Again, as a matter of these hearings, a total non-issue. As a political matter as the public watches the hearings, DiFi is on the losing side. This boils down to "trust," and more people trust the President on national security and restraint in investigation than trust Congress. To the extent Congress is seen as politicizing a security matter, they are making a dumb move.

Sheeeeesh. DiFi simply runs out of things to say, asks no questions, and Alito politely suggests: "Well, I guess the question then would be..." and answers a question never asked.
He makes her look idiotic.

DiFi is so rambling and incoherant that Alito could say anything in response and as long as he was calm and scholarly acting it would sound OK.
I think he'll get at least a couple of votes because if they give a complete shutout, given how many questions he's answered, it will be obvious that none of them EVER intended to vote for him from the start and deaming the hearings completely pointless.
Still deciding the ye votes.
