Day 3: Questioning Continues
This morning, Round 1 concludes with Senators on the Judiciary Cmte. who did not question nominee Alito yesterday. During Round 2, questioning is limited to 20 minutes for each of the eight- een senators. Chairman Arlen Specter (R-PA) leads off, followed by the others, alternating by party in order of seniority.

I wish Alito would simply say ABORTION IS NOT IN THE CONSTITUTION. All arguments regarding it must be heard and therefore decided upon!!!he and Cornyn went over this last night.
CORNYN: And I just want to explore, to start with, Senator Schumer's questions about what is written in this Constitution about abortion. Does the word abortion appear anywhere in the Constitution?
ALITO: No. The word that appears in the Constitution is liberty.

I don't have an exact time frame for you, but it was sometime in the late 80's I believe. There was a story about it on WLS radio and I think in either the Sun-Times and the Tribune.

Alito, from my memory of recent nominees, has given the best and most fair answers on Roe. It is really pathetic and telling to hear Democrat after Democrat push him to commit to an opinion regardless of what facts may come.

Findings of FACT. Legislative findings of the facts on which Congress based the passage of a law. Such as " machine guns are not arms covered by the 2nd Amendment because they were not the type of weapon commonly used in by the troops in warfare when the Constitution was enacted." (I just made that up, of course.)
When judges decide cases as opposed to juries, judges make their own "findings of facts" so that an appeals court can review their actions.

Would you want to be on record with an "always statement" if you were about to become a SC justice? The law is about exceptions. The analysis and discussion at Confrimthem is pretty good. The question can be construed as "Between a Supreme Court precedent and the Constitution, which has superior force?"
The answer depends on how one sees the Supreme Court precedent as being in conformity with the Constitution, and the extent of force the precedent retains - but if there is a difference between precedent and the Constitution, and the precedent is toady an active force in law, most people will say the Constitution prevails.
