Just because there is a natural instinct to protect "our side" we shouldn't let facts not get in our way. Scooter Libby, though still legally innocent, almost certainly committed perjury. The end.

I think Libby was dumb in leaking to the NY Times to start with when Cooper was married to a Clintonite. I don't see where Cheney would have had a problem since he is not the one that leaked to reporters. Maybe I am missing something.

Libby told the grand jury he heard about Valerie Wilson for the first time on July 10th from Tim Russert. He talked to Judy Miller about her on June 23rd. This is not rocket science here. Most perjury cases are muddled, this one seems pretty straight forward.

Whether intentional or not, Libby has lied, the real question is if he did it intentionally, why? We have more or less learned Plame was not covert so there could have been no outing, but did Libby know this and was he just afraid he might have?

It was just the stupidest thing to do, it's always the cover up that gets them and in this case a cover up of something that wasn't even a crime.

I think Fitz is fishing, he's just changing lure's now.

Thanks, but one thing I missed is how wide Fitz would go - or not go. There are a number of things I would've expected to be fleshed out a bit more - who was on Marine Two deciding how to respond to inquiries, on the same day Libby talked to Cooper? What did they talk about, and what was decided, etc.? I figured he'd snag an aide or two to Libby.

And, of course, the lingering mystery question - who was Novak's initial source?

Given the descriptions in the indictment - if the information therein is true - I think Fitzgerald showed a great deal of restraint.

Restraint for what? This whole friggin thing was supposed to center around who outted a COVERT CIA AGENT we learned yesterday after a two year investigation has concluded know one has!!! All Fitz did was indict someone who supposedly lied about WHEN he obtained Plame's name...Who wasn't even covert and being bandied about in Washington like front page Inquiry News!

That's so friggin lame and bogus it's not even funny. Fitz did nothing more than went on a fishing expidention to hook a BIG mouth and got one.

We've now learned there is truly no "leaking" here by anyone, and let me also say this, MILLER has big one's for trying to protect Libby, at least it appears she was really trying to protect him now.

So its not years but not weeks either its months? Honestly what really turned me off about Fitz was his suggestion and implication that she was indeed covert and outed intentionally. In fact he accused Libby through innuendo of doing exactly that apparently trying to give his indictment some solid ground of an underlying crime. Libby may deserve a slap on the wrist but nothing more IF this is all he has.

When you learn what the word 'classified' means, come back and we'll talk.

The guy said plainly that the reason he didn't bring an 'outing' charge is that he couldn't reasonably make a determination whether the - read this part carefully - revelation of CLASSIFIED information about Plame's employment was intentional, inadvertent, etc. And he said plainly that one of the reasons he couldn't make that determination is because Libby constructed a cover story to hide what actually happened.

A prosecutor with less restraint could take two little pieces - the 'non-secure phone' comment and the need to lie to cover-up what happened - and fairly make the argument that Libby INTENTIONALLY revealed the classified information.

He made no such suggestion. He plainly said he wasn't making such a contention.

Libby apparently makes such a suggestion himself, with his admission that he shouldn't talk about her on a non-secure line.

But I'm glad to know you are now on record as saying that lying to a grand jury deserves a 'slap on the wrist.' Does that apply regardless of political affiliation?

You can go on all day with the 'not covert' meme. Her employment was 'classified' information, whether she met the IIPA statutory definition or not.

If the testimony as set forth in the GJ was accurate, Libby could either admit that he disseminated classified information to reporters, or lie and hope he didn't get caught. Looks like he stupidly chose the latter course of action.

If you haven't read the indictment, it is quite plain to anyone with a little common sense that Libby knew the information was classified. And that information comes from other WH witnesses, not reporters. The obvious answer to your question is THAT'S why he lied about it. He knew he did wrong (I'm not saying here he violated IIPA - but revealing classified info to reporters for political reasons is WRONG. If you want to take issue with that assertion, have at it. I hope you do.), so he tried to cover it up. Like a 5 year old.

RIIIGHT. People don't routinely describe periods just like this one as "weeks." Every friggin' day.

That's right in line with your suggestion that people who lie to grand juries don't deserve much of anything in the way of punishment.

It is a good thing for you, apparently, that you don't find yourself in many situations where you rely on people to tell the truth, since you place such a low premium on it.

Grow up! It wasn't intended to be an insult just a clarification for accuracy. Apparently accuracy is not something you rely on. Truth? How the hell do you know if scooter remembered where he heard it or not and that he LIED which is an intentional act. Time frames may be important, I know damn well how many times I swear I remembered something a certain way only to have it shown to be wrong. You want to personally attack me bring it on. I don't back down. You seem to think you have the market cornered on truth.

Lying to the GJ is serious but Fitzgerald's press conference was BS plain and simple. I have no faith that he is a stand up guy Your Highness.

But "classified" is not covert, and according to the guy who helped author the '82 (?) law I heard on WBAL interview yesterday, plainly said this law could in no way be applyied to this case as well as Fitz himself stated, his investigation concluded NO ONE OUTTED A COVERT AGENT...

There is no way on the face this earth she could have been outed! Fitz knew this, so his Classified comment was B.S.

Let me make this point, it maybe the case that he made a mistake and named her, but he is not charged with releasing classified info, he is charged with lying about it...So regarless, if he would have told the truth Fitz wouldn't have indicted him even for relaying "classified" info.

Fitz went fishing.
