The problem is, "legal philosophy", taken in a vacuum, doesn't illustrate anything. The way Miers and others talk about how judges shouldn't "make law" leaves the impression that there are other judges who think they should "make law". But you know what? There isn't a single justice on the court who would actually say that. They all claim to be applying the law (just look at what Breyer has to say for himself). They just have different views of what the law is.

So the only way to evaluate whether or not a judge is the right pick is to evaluate his or her actual understanding of the law. Thinking that we can somehow get around that by looking at "philosophy" alone is just wishful thinking.

No, he needs to do the right thing by putting forward an originalist nominee. Then we'll support him. Support is earned, not granted. I've given enough in time and money, as have many others.... Now it's time for him to show his best hand.

He was reading the initial report, which was from Dobson/McClellan, who got it from Rove. Later, someone asked associates of Owen if she was one of the ones Rove talked about to Dobson and it was flatly denied.

If they had much political sense, they would've gone for Janice Rogers Brown in the first place, given that she's got preapproval from the filibuster compromise.

The dems would fillibuster Brown, the question is whether or not there would be enough Republican support for killing the filibuster rule (the so-called "nuclear" option), my guess is that there wouldn't be. If Frist can't even muster enough votes to support Miers, how on earth will he muster enough to overturn the filibuster rules?

So that means that Brown/Luttig/Owens would all be DOA, there would be a big fight, but ultimately they would fail. I think the Bush team realizes this.

Why don't you quote me the one(s) that justify the bloodbath that isn't necessary?

Geez, some folks here are as bad as the Congress itself about forgetting who has the majority. A credentialed, repected conservative who takes his/her judicial role seriously without making a special point of being a bomb-thrower has absolutely no impediment to confirmation in this Senate. None.

Well that's sort of my point, really. Are they willing to risk getting voted out of office by working against their constituency? If so, then their constituency can support a conservative in the primaries. We tend to forget that just because they are in office with an (R) after their name doesn't mean we can't find someone better.

She is only about 45 years old, has two teenaged sons and is the former wife of conservative radio host and author Charles Sykes.

Even better. (Could be on the court for 35-40 years!) Plus, I grew up in Wisconsin, but I've been out of touch since my parents moved to NC in 1989. So it'd be nice to have a Cheesehead (er, Badger) on the SCOTUS. Good Midwestern stock.

You're right that there is a degree of risk in what has occurred.

But the risks of an unknown quantity like Miss Miers being on the court for decades outweighed the risks of getting someone worse, I think.
