I really don't care about her personal beliefs. I want to know if she will apply someone else's (e.g. Madison's) beliefs.

Ditto!

... why not have picked someone obviously like a Scalia....as he promised during his campaign...to get strict Constitutionalists on the bench?

Each possible nominee comes with unique issues, the calculus is quite complicated. Miers may in fact be a strict Constitutionalist; but her confirmation hearings are going to be more about her qualifications that about Constitutional principles.

I think neither GWB nor the Senate want to fight on a matter of principle. Other than the principle of "Go along to get along."

You know, all this talk of a head fake, no paper trail, the dems will eat her alive, etc. reminds me of how conservatives reacted to CFR:

It will never pass.
If it does pass, the SCOTUS will rule it unconstitutional.

This will be another CFR- the dems will applaud the choice, a few Republicans will jump ship and vote against her, but she will be approved.

And all that alleged strategery will have backfired.

"Senate Minority Leader Harry Reid, D-Nev., had urged the administration to consider Miers, two congressional officials said. There was a long list of staunchly conservative judges that Democrats were poised to fight, Miers not among them."

Reid could've said that to try to scotch the appointment, you know.

The reason we're unhappy (to put it mildly) is because he RENEGGED ON HIS WORD and did not pick a justice "in the mold of Scalia and Thomas".

FNC just said.."a number of Democrats suggested she would be a good choice". And THIS makes you comfortable?!!

She has ZERO judicial experience. THIS is qualification to be on SCOTUS?!! For the love of God!

You know that the Dems will pounce on her no matter what. There is lackluster conservative support for Miers. Bush had a great opportunity and made a pass. How can you make lemonade on this?

There is no constitutional requirement for a judge to be a lawyer or even have judicial experience at all. As a professional pick - I wouldn't have chosen her. But as a political pick - its brilliant. No paper trail and no controversial views. I can just see Ann Coulter ripping the President a new clymer over his latest nominee. Roberts looks stellar next to Miers. There were better candidates but the President didn't feel up to a prolonged fight with the Democrats. Bottom line as I see it Miers will be no better than O'Connor and she can hardly be worse than Souter.

If the Pres. personally knows her, then don't you think he knows better than most how she personally feels about some subjects? And at the same time, she might not have much of a paper trail.

The writeup I read on her the other day verified her as being a conservative.

She won a Sandra Day O' Connor Award.

She appears to be a Sandra Day O'Connor clone: only apparently conservative going in, eminently malleable to the liberal will. Only time will tell for certain, but all the signs are there.

Instead of taking the fiight to the liberals who have worked so hard destroy the social fabric of our nation, I fear that Bush may have meekly capitulated to the liberal social agenda and sealed our fate and the fate of our children by enabling another two decades of arrogant judicial legislating.

This was Bush's big chance to make a difference. Nothing else he has done was of this magnitude. This was THE test of his leadership mettle.

I pray I am wrong; but my gut instinct tells me I am not.

"Maybe Bush picked her out of loyalty but knows she will never be confirmed. Perhaps he has someone else in mind but puts this woman out there first to let the dems do their chewing up and spitting out. Then when she doesn't get confirmed, he picks his REAL choice:"

I hear a bunch of you saying this, presumably to make yourselves feel better. I don't buy it. To do something like this would be so far out of Bush's character, I can't see it even as a possibility. If nothing else, he's famed for being loyal to his friends - I don't think he would ever put someone out there just to have them knocked down.

The Democrats will eat this alive

I just heard on the radio that AP is reporting that Harry Ried first suggested to Bush that he consider Miers.

We used to spray diesel on the backs of groups of hogs when we mixed them together for the first time. Made them all smell the same and really cut down on the fighting. Well it is time to get the disel sprayer out. We are starting to EAT our own

Dick Cheney has worked out all right, hasn't he? I think Ms. Miers will, too, and for the same reason

Cheney had a proven track record in previous administrations, and as an executive in a big coporation. He was a better known quantity for the position he was seeking, by far.
