it exposes just how bankrupt the left is.

It exposes how those that consider themselves to be part of "the elite" (left or right) will save their own asses and the rest of will just have to fend for ourselves.

Lots of folks died in the City of New Orleans because he didn't follow his mandatary evacuation plan.

Seem like it should be against Nagin and Blanco accessories.

I'm afraid they skate by on this one.

We should enact a law that states that any Mayor/Governor that does not evacuate their city when a Cat 2 storm (or greater) is within 48 hours (or less) the local officials shall be thrown in jail.

The OWNER was reported to have passed up transportation with two buses for the residents, so I would think the owner is in very deep doo doo.... but maybe all of them are since they had a "duty of care" not to abandon their residents/patients?? (I don't know their law, but apparently the LA Atty. General thinks it is clear).

And the Mayor and Governor who failed to execute any part of the evacuation plan...?

This crap about the Feds not laying it on the locals is ludicrous.

If any charges are to be filed against anybody, the first look should be directed to Mayor Numnut Nagin and Gov. Bozo Blanco. The longer the press and the RATs beat up on Bush and FEMA unimpeded by a decent Republican response, the bigger the whole we have to climb out of.

Bush should be going on natioanl TV and demanding an investigation be launched at the nursing home, the Mayor, the Governor and all those repsonsible for carring out the LA evacuation plan that we taxpayers have spent millions for.

Silence is not golden in this case--more like a rusty shade of rot. Republcian officals better get off their butts and start layng the blame where it belongs. This self-imposed punching bag routine that Bush and Co. seem to like to play is insane.

I wonder if Broussard will be called to testify at the trial, seeing as how he's placed himself as a material witness in the case, having received all of these phone calls.

Could be interesting...

The State Attorney General cannot charge them, as it is up to the local DA to file charges.

Wow, that's REALLY bad. Kinda like Mayor Nagin!

Judge Napalitano said this is very serious, and that this would be the same as if the patients were withheld food or water (among other things).

Probably why he used THAT as the analogy... I know he kept explaining away the laws AS law - but he said they were bad laws to begin with.

"seeing as how he's placed himself as a material witness in the case, having received all of these phone calls"

Guess we should be seeing cell phone and office phone records subpoenaed for Broussard and his Emergency Director, to help establish the timeline and see when the ED mother's last phone call was.... Oh, but it's corrupt LA, so Democrats may not want to air their dirty laundry and expose Broussard as a vicious fabricator for a political smear job....

The families should have evacuated the patients. The nursing home should have evacuated as many as possible although that's a lot of patients to move on short notice. What a mess.

Unless they lockup Blanco and Nagin too then this is nothing more than attacking private citizens bad judgement while excusing the same for public officials.

I'm very disappointed with him. The law is the law. Judges don't make laws...they ensure the laws are Constitutional. IMHO, he's another activist judge, by condoning judges making/breaking laws from the bench.

According to Fox News just now, the owners were given opportunities to get the patients out in advance of the storm and refused to do so

I can't imagine why they would refuse to do so. Strange.

Considering the closeness of the last gov's race and the shifting toward the Republican side in LA, I've got to believe that at least half of the the population is fairly clear headed. I am confident a majority of the LA residents understand the tragic chain of events very well and will see to it that, at least politically, the guilty are punished severely. LA will be a red state for years and years to come IMHO and the Pres. needn't say anymore than he already has. The obvious is just that---way too obvious for the demonrats to make hay out of this pile of manure. They are in the middle of a mega Wellstone Moment. I say let em have it!

Is Broussard the only civic representative of St Bernard's Parish. Did they have anything like a city council? It sounds like they had a coroner. Did they have any policemen, firemen, doctors, nurses, neighbors? It sounds like the ones who evacuated never tried to help any folks who didn't get out in time. I wish our intrepid reporters would give us a bit of a tutorial in NO area politics. /rhetorical questions.
