Bush to Nominate Roberts for Chief Justice

Newsreaders on FoxNews just said a 'Senior administration spokesman' has said Bush plans to nominate Roberts for Chief Justice position.

Thats should be a position reserved for members who have experience on that particular court.

Scroll back up the thread. That's not how it's usually done. In fact, only 3 times in history.

I don't know. This seems like the worst possible strategy to me.

Scalia is obviously best qualified for CJ, Thomas easiest to obtain. Now we have an unknown being raised to CJ, which means the Dems will obstruct even harder to avoid being saddle with a presumed conservative-led court for the next 20-30 years. AND O'Connor stays until a new nominee is confirmed, giving more time for delay and obstruction.

Is there something I'm missing here? Maybe this is something to give the appearance of uncertainty and conciliation until the Nuclear Rogers Brown option can be deployed?

The President is ahead of them on every turn.Now possible one battle for a real conserative to replace O'Connor. After all the carping about another women, Owen or Brown would be good choices.

Yes, indeed! A VERY conservative, Constitution-honoring woman would be a great choice.

Well, my question was a 2-edged sword. Does O'Connor think that Roberts' confirmation is enough to make her retire?

I would love to see Brown on the court, but if Scalia has been talking to Bush and Scalia plans to retire during Bush's term, it might be the case that Janice Rogers Brown is being held in reserve to replace him. She's outspoken and very conservative (with regards to stare decisis she's even more willing to overturn stupid law than Scalia). The "like for like" arguments wouldn't work for Brown.

Luttig and Owen are standard names for the next open spot. Let's just say that I am glad Rove is on our side. With simultaneous nominations, Rove will probably play a good cop-bad cop with Roberts as good cop. Roberts is almost guaranteed to sail through while the other nomination will suck up all the Democrats' oxygen. I think the timing of the second nomination will be such that Roberts will sail, even though the WH will say that it's being delayed because the President is focused on NO.

I can almost guarantee that Thomas does not want another confirmation battle. Not after what he went through with the last one. I think Scalia should be elevated, personally, but only because I think he is one of the greatest minds this country has produced in government and should be recognized as such. The fact is, he will retire soon regardless.

We would have won only with a Scalia for CJ and a replacement of Stevens (or Souter, or Ginsburg). Roberts is still a "?" (surely he doesn't look like to Rehnquist) and the Supreme Court remains anti-life and anti-business, among many other issues.

Here's a better argument: Bush wanted to put a Hispanic (Miguel Estrada) on the lower court. But the Democrats didn't think that was important enough to confirm him.
