But state Fish and Wildlife officials insist the officers were only doing their job. Nonetheless, theyre looking into Erdmanns claims to determine whether the officers may have been overzealous jack-booted fascist a-holes. There. Fixed it.

Go after the ducks but not election fraud, what a bunch of liberal crap. The Duck is very happy and apparently well cared for.Nature would have solved the problem when the Ducky got horny.

Similar thing happened here in South Texas a few years back with "Bubba," a pet javelina (wild peccary). They actually make good pets, and he was a very loved and spoiled pig, but the Texas Wildlife people came and took him and released him into the brush. It most likely died fairly soon thereafter, since it didn't have a clue as to how to survive out on its own.
But hey! Government knows best, right? Sure they do...

WHAT A PACK OF LIVING, BREATHING A$$HOLES!!!!!!!!!!!! If the duck were being abused I could understand this, but the duck plainly was happy. If Gooey had wanted to leave, he would have done it under his own steam. WHERE IS PETA WHEN YOU NEED THEM???? THEY SHOULD DEVOTE THEIR TIME TO INCIDENTS LIKE THIS INSTEAD OF THROWING PAINT/BLOOD ON FURS WORN BY PEOPLE.

The officials had no search warrant. Their seizure of the duck is therefore illegal, and they are therefore guilty of a Federal crime (it's a Federal crime for State officials to violate the Constitutional rights of a US citizen.
Title 18, U.S.C., Section 242) Deprivation of rights under color of law:
Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties, on account of such person being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

When I was 16 (about 1978) I traded an old sleeping bag for a baby Red-Tailed Hawk, she had a broken wing. I went to the library and learned all I could about this animal. I never put her in a cage, or tethered her. I fed her (Screech) live animals, like rats,mice,chickens, etc. I had her about six months before Calif Fish and Game showed up. She was perched on a ladder in the back yard and I ran back and threw her into the air. She flew to the top of the barn and gave me a look like what the heck was that all about. The two wardens told me and my mom that they were not there to confiscate the hawk or to arrest anyone, they just wanted to check her out for diseases and the like. He asked if I could retrieve her from the roof top,and I naievly believed them about them just checking her out. So I whistled her down ( yes, she would come when I whistled) and handed her to Jack Raines the game warden and he handed her to his assistant and told him to put her in a box. He then turned to my mom and told her he was citing me for possession of a bird of prey, and that they were going to destroy her. I asked if I could get a permit or license to keep her he said no. From that point on in my life I have a hard time trusting "authority" as I usually just don't believe a word they say.
I went to juvenile court and the judge threw out the case due to the fact that I never truly had her in my possession as the Hawk was free to fly away at any time. At that time i guess it was illegal to hold them in captivity of some sort.Anyway the judge did chastise the warden for the destruction of the hawk. Stretch" was a really beautiful bird,and all the neighbors liked her
