NYers to NYPD: 'I Do Not Consent to Being Searched'

Reacting to the NYPD's announcement Thursday afternoon that police would randomly—but routinely—search the bags of commuters, one concerned New Yorker quickly created a way for civil libertarians to make their views black-and-white. In a few outraged moments, local immigrant rights activist Tony Lu designed t-shirts bearing the text, "i do not consent to being searched." The minimalist protest-wear can be purchased here, in various styles and sizes. (Lu will not get a cut. The shirts' manufacture, sale, and shipment, will be handled by the online retailer. Lu encourages budget-conscious New Yorkers to make their own and wear them everywhere.)

Police Commissioner Raymond Kelly had announced the legally obvious—that New Yorkers are free to decline a search and "turn around and leave." But Lu, who is a lawyer at Urban Justice Center, warned that even well-intentioned cops could interpret people's natural nervousness or anger as "reasonable suspicion." The possibility of unjustified interrogation and even arrest is real, Lu said.

Although police promised they would not engage in racial profiling, Lu said that, as with all street-level policing, people of color and poor immigrants would be particularly vulnerable, especially if encounters lead to arrests.

Being "public" transit, and thus not being a "privilge" (the excuse they use for driving) or a private airline ... I wonder how will this would hold up to a legal challenge.

And what if you have alrady paid the fare and you refuse once inside ... they would have to have some kind of refund mechanism. Putting up a sign in a public place doesn't make it so.

Yeah, because a savage who's made up his mind that he's going to commit suicide and take a couple or a few score of innocent people out with him is probably the kind of person who'd have second thoughts knowing he stood a 1 in 1,000,000 chance of having his back-pack inspected by a cop.

the issue of the political courage of elected officials is something I agree with you on - they have none, they won't just come out and say "we will profile".

Do you know about the politician here who slugged a traffic cop, then demanded the traffic cop appologise?

One of the London bombers (yesterday) was wearing a "New York" shirt. Coincidence or or a message that they are next? Let's see how well that shirt sells WHEN hell comes raining down on them.

This is also a city that openly refuses to notify the INS when illegal immigrants are arrested by the police.

F#ck them, and f#ck their stupid random searches. The brutal truth here is that the only way they can effectively prevent terrorism in New York City is by engaging in large-scale deportation and de-populating large swaths of this urban toilet.

Not a problem. But you forfeit the right to complain if a bomb goes off in the subway.

No you don't. You complain all you want about the bastard that brought it in. Same of they just blew itup on a street corner.

Not being invaded doesn't nullify the right to complain if someoene does something stupid.

Maybe we should make it illegal for anyone to leave their house. After all, if you leave your house, and something happens, you can't complain.

I suggest the New York cops use the British system. Shoot five shots into the head of anyone who refuses to halt and be searched.

That would solve it nicely.

Irrelevant. It's the searches that are unreasonable, because they are random. Others are not stopped for a search. Probably a equal protection clause violation, as well.

Are you suggesting it's reasonable to deny a citizen access to the subway just because of the t-shirt they're wearing?
