Robert Novak is reporting that William Rehnquist will retire at 4:50pm today when the President lands in Washington.
A source close to the White House tells me that the White House is operating under the assumption, based on presumed knowledge of Novak's source, that this will, in fact, happen.
Third party sources are now telling me that the John Paul Stevens rumor is true and that the White House is now planning for a third vacancy, but not until the end of the year. Third party sources, who I treat as credible, say that Stevens has begun taking actions in his personal life to make arrangements for personal affairs. It is presumed that Stevens is taking steps to retire. A separate third party source tells me that Ginsberg is not expected to retire, as her health is fine. But, that Stevens has sent signals that he will retire once replacements for both O'Connor and Rehnquist have been confirmed

I wanted to sucker punch the democrats.... confirm one huge conservative, promte Scalia or Thomas, and then go for another huge conservative.
Let the rollagon bodied Senator from Mass continue to worry about replacing the first of the three. O'Connor has said she will stay on until her replacement is hired, but will not stay to train him/her.

Stevens has been interviewing and hiring clerks for the 2006 term. I doubt he's leaving.

If we can actually get conservatives on the court, the libs will be TOTALLY out of power for the forseeable future.

I'd rather Thomas then Scalia, but Scalia would hardly be bad.

I was of the opinion that since Rehnquist of late was able to attend sessions, he probably would not retire. I think Ginsburg was even sicker than he with her cancer bout years ago, and she didn't retire.

Not even remotely close.
She is in even worse shape then Rehnquist.
To be frank, she isn't even doing her little "tours" anymore (visiting law schools, doing speeches, etc).
She is going to quit before this year is out, if not, she'll be off the bench next year by passing away, her health has totally deteriorated, and no amount of help from Souter or Scalia (him and her are actually close friends, both of their families vacation together) can cover for her.
With the exception of Clarance Thomas, they all claim to be huge supporters of stare decisis.
Thomas never said he doesn't support it but all of his co-workers say it.
Forget conservative or liberal, any judge who says they disagree with the concept of stare decisis would be voted down.
Borks interpretation of stare decisis is the right one to follow, I would like more judges who had his logic, opinion and reasoning.

SCOTUS blog says this is BS...Drudge now says he WILL retire....definitely.....and it will be announced tonight.
This is weird. I can't imagine Drudge being SO gung-ho about something without solid evidence from Novak, but who knows.
Drudge is even more adament now and says there will be an announcement this evening.
But, SCOTUS blog is pretty knowledgable.
I can't imagine Novak being rock here, but it could happen.
Any idea what time we are to anticipate this annoucement?

I think it would be pretty funny if Novak has egg on his face with this "scoop" that turns out not to be one.
well, Drudge has now changed his headline again......"Report: Rehnquist to retire"
Looks like he is backing down.
Probably nothing will happen then, which puts into serious doubt the entire report by the folks at Red State here, including their supposed confirmation regarding Stevens.
It is well past 4:50 on the east coast and nothing has gone down.

Red State has updated and said the retirement has occurred......this is not confirmed by Drudge (who seems to be backing off the story) or any other place:
Red state update: "Update [2005-7-8 17:20:42 by Erick]: William Rehnquist, Chief Justice of the United States, has retired. A White House statement is forthcoming. Should caveat this: A very good source says this."
He also said 2 other sources told him that, though no WH sources.
