O'Connor's seat will be a tough fight, but nothing like the fight over Ginsburg, Stevens, Souter, or Breyer. Those are the solid liberals. Ginsburg and Stevens are old and not in good health, and I am one hoping that they will be the next to announce retirement.

4-4 decisions on the SC isn't the worst thing that could happen if there fight is drawn out. Except with Kennedy -- the other swing vote, we'd see a lot of 5-3, and those certain to be the wrong way.

MANY Republican senators? I think not. To the best of my memory, Bork's justification for his actions was not attacked during the confirmation hearings. Those GOP senators who eventually voted against him stated that they did so on grounds of general legal philosophy.

Did you see what he put up before saying what he did -- that's what I am talking about. You obviously haven't been reading threads on here lately with the sky is falling approach. Instead of facts, we get feelings about what might happen. I thought his post was inappropriate because there are no facts to back up that supposition but he covered himself with saying he didn't believe it -- then why post it?
