That is not true. The Supreme Court has ruled that the U.S. Constitution does not prevent local governments from seizing property for this reason. It didn't rule that the Constitution forbids the States or the Congress from prohibiting such seizures. In the case of the Congress, there would be federalism questions (which I think valid) but it's difficult to see how it wouldn't fit into the Commerce Clause as interpreted by the Court (wrongly, in my opinion, but so it is). Most especially, it doesn't prevent the Congress from amending the Constitution itself.

If the support is truly there, the laws will get amended accordingly.

There is some question whether rentals are residential or commercial. It is a business with contracts, law, and public regulation.

I'll admit that I'm not up to zoning codes these days. In our situation, our landlord sold the property. The new owner must comply with the zoning code. There was a "grandfather" clause when the code was changed years ago, and the previous owner kept it residential. I can understand that, what I worry about is that if we move to a "blighted neighborhood", how long before we would have to move again, due to imminent domain, or urban renewal?

I doubt Congress will do a dang thing. With the new bankruptcy rules, coupled with this ruling, the stage is set.

Hope you all enjoyed the dream of the Republic, but then it was probably dead well before any one here was born.

Wheter it is liberal or not we don't know anymore. It does smack of fascism, which we usually associate with the Left. It would be a shame if our Constitution ends up supporting fascism.

I have an idea how we send a message to SC and Congress.

Every home owner in the usa needs to put thier house up for sale, don't have to sell it, but imgaine the effect of 50 million homes put up for sale at the same time. I think government would get the message.

And everyone needs a reminder that the current court is loaded, 7-2, with 'justices' that were appointed by Republican Presidents. A good thing to remember when judging the quality of soon-to-be-coming nominees.

Thanks, for stating what should be obvious. IMO, it's past time to raze DC and salt the earth so nothing political ever grows there again, but I've been of that opinion for some time now. To think some here were anxious for a 2nd Amd case to hit these tards. Blackbird.

I give it long odds. The spineless senate would have to drive the legislation, since the house is viewed as pandering and reactionary. I'd love to know the last time the court was smacked down on a USSC ruling.

As a couple of people have pointed out, when Freepers and DUers agree on something, you KNOW there's a serious problem.

Considering that each are viewed as the "fringe" by their respective parties, I'd say it means they judges will soon realize that they are outflanked.

I am afraid what will happen then.

The thing with zoning codes is that they can be changed at any time, both in the kind of zoning that is applied to the parcel and in the basic definition of what a particular zoning class means, and that both in wording and interpretation. In all cases it is local rather than national or even state-wide. Grandfather rights exist at the whim of the zoning agency.

The Congress can amend the Constitution or impeach the justices, those are the two remedies. Dred Scott gave us the 14th Amendment which yielded all sorts of mishief. Since I think the Constitution is clear, my druthers would be for Congress to impeach the justices who signed unto theft as a power assigned to government by the Constitution. But they don't have the balls for that. They might have the balls to amend the Constitution though the language will have to be short and sweet so as to allow no further mischief by renegade courts. Something like this:

Any SCOTUS justice authorizing theft by illicitly using the "takings clause" while ignoring the "public use clause" will be hung.

We get our well water from an aquifer. Plenty to go around I would imagine...I hope.

Hope in vain. Just 30 years ago everyone in the San Antonio, Texas area thought the Edwards Aquifer, one of the largest in the nation, had plenty to go around. After all, it was a monster of an aquifer, right?

Today, there are real concerns that the aquifer is not going to survive the population pressure without some strict rationing on usage. Extremities of the aquifer have already collapsed. And once they collapse, those areas cannot ever be recharged again.

All this will affect you, it just might take a little longer, is all. Run as fast as you can...you'll just die tired.
