The Conservables (and their allies, the Liberatives) have been against this amendment from the start. Required to give one's name to LEO even though not charged with crime; property seized if it might be valuable enough to be result of drug deal; torture of terrorist suspects or those who checked out the wrong book; seizure of property if the renter used it improperly, etc.

No surprise here; just a small change in the term "public benefit."

The issue at hand is different. In your grandparents' case it was for use by the government/public use-railroads, bridges, dams, etc.. THAT has been going on since the founding of the nation.

The 5 morons on the Supreme Court made it okay for a city, village, county to go & seize our land/property/houses because some a$$ developer wants to build a mall. The bottom line is tax dollars.

As someone mentioned earlier. Churches are now fair game.

Seriously, I was making a little joke there. I live in the desert. We've got mice, turtles, and "rare" joshua trees that are protected. I read where they were going to shoot and poison the ravens to protect the turtles. My first thought was how to make turtle soup.

I was just thinking it would be funny to turn the environazi crap on the government for once. :-)

I'm convinced that this is nothing less than a full-fledged communist power grab in the heart of America by five Liberal judges. I can't believe the American people are for this, has there been even one poll on this issue? I doubt even Howard Dean would be for this, if the media has any balls or sense of justice left to speak of they'll conduct one.

James Madison was right, there is growing potential for tyranny in this country and it's coming from the judiciary. I've thought this through and I know I'm not overreacting. There will not be a civil war in this country, if there's to be a war it will be the people against the government.

The 14th Amend was added to prevent the States from trampling on the rights of it's citizens. In particular, citizens with a minority status. In these eminent domain takeover cases, there is little, or no motivation for others to side with the pillaged.

"The city’s determination that the area at issue was sufficiently distressed to justify a program of economic rejuvenation is entitled to deference. The city has carefully formulated a development plan that it believes will provide appreciable benefits to the community, including, but not limited to, new jobs and increased tax revenue. As with other exercises in urban planning and development, the city is trying to coordinate a variety of commercial, residential, and recreational land uses, with the hope that they will form a whole greater than the sum of its parts. To effectuate this plan, the city has invoked a state statute that specifically authorizes the use of eminent domain to promote economic development."
