Mr. CORNYN. I ask unanimous consent that when the Senate completes its business today, it stand in adjournment until 11:30 a.m. on Monday, May 23. I further ask that following the prayer and pledge, the morning hour be deemed expired, the Journal of proceedings be approved to date, the time for the two leaders be reserved, and that the Senate then return to executive session and resume consideration of the nomination of Priscilla Owen to the Fifth Circuit Court of Appeals, provided that the time from 12 noon until 1 p.m. be under the control of the majority leader or his designee and, at 1 p.m., the Democratic leader or his designee be recognized; provided that floor time then rotate between the two leaders or their designees every 60 minutes until 4 p.m., at which time the majority leader or his designee be recognized until 4:45 p.m., to be followed by the Democrat leader or his designee from 4:45 p.m. until 5:30 p.m.

Mr. CORNYN. Mr. President, on Monday, the Senate will resume consideration of the nomination of Priscilla Owen to serve as a circuit judge on the Fifth Circuit Court of Appeals. Monday will be the fourth consecutive day the Senate considers the Owen nomination.
Over the past 3 days, a number of Members, on both sides of the aisle, have come to the floor to speak on the nomination. We have conducted over 25 hours of debate, and we will continue on Monday. Moments ago, we filed a cloture motion on the nomination, and that will ripen on Tuesday of next week.
On behalf of the majority leader, I remind my colleagues the leader has announced our next rollcall vote will occur Monday afternoon at 5:30. That vote will be on a motion to instruct the Sergeant at Arms to request Senators' attendance. Senator Frist will have more to say about next week's session on Monday.
He needs a few charts to put up...................
Grassley just took a shot at the pundits by calling them 'uninformed' in attempts to suggest a couple of nominees were filibustered, when they were not. I love it when Republicans stab the MSM.
DeWine has an election in '06.

Actually, I think what they are doing is looking for a way to get these people confirmed. It's what they've been trying to do within the rules all along. The Rats have hung together and tough which leaves ONLY A RULE change to beat them.
I'd much rather let the Rats have their whiney issue than to let them have the Supreme Court.
His delivery may not be rousing, but his content is electifying. He is now talking about the radical left control on the judiciary. I see they know what we know :)

So, as I see it, this should be in the bag for Frist unless, there is some blackmail or payoffs or something that would make otherwise obvious voters for Frist to go against him...
Surely, they aren't stupid enough to think that McCain could be president in 2008 and they would have to answer to HIM!!!!

This is SOP with plenty of precedent and history. What the Dems are doing, filibustering appellate judicial nominees, is without precedent. Essentially, they are saying you need 60 votes to confirm an appointment and not a mere majority as has always been the case when voted upon on the floor of the Senate. This is not about statistics but precedence.
Yes, Grassley is a bit tame in tone but his statements are powerful so I am making the effort to listen. His words are worth the effort.
Grassley- Travesty is that Owens and brown waited years for confirmation vote. Travesty is that Estrada wasn't going to fight any more. Travesty a good name of a nominee is dragged through the mud with unfounded allegations. Sends clear message to good people that would serve country that they would have to endure the same. Far Left litmus test to satisfy their out of the mainstream wing. Oh! he just took a shot at moveon'org and DU. lol

I think the reasoning was, in the article I read, that Collins is the Chair of a very important committee and wouldn't want that jeopardized by going against Republican leadership. Also, she is hot under the collar about some bases that are on the BRAC list...

I agree. It is about adhering to the Constitutional balance of powers between the president and the Senate, and it is about adhering to basic parliamentary practice where, once informed, a participant becomes willing to vote.
The following link from Project Vote Smart shows Senator Frist's ratings from various interest groups. Groups that have given him a rating of 100 for a given year include National Right to Life, American Farm Bureau, US Chamber of Commerce, and Eagle Forum. He has received 0 ratings from NARAL, Planned Parenthood, ACLU and NEA. Sure sounds conservative to me.

Now you're making assumptions. I never claimed Frist was a RINO. Go ahead and read all my posts. And my contention was not that Frist had to be dragged kicking and screaming into supporting the constitional option. That was your reading of it. I said that he was dragged kicking and screaming to the right thing. Meaning being forced to act. He would not have acted without the pressure. Because of this, I don't think he deserves an apology for the frustration and anger that his inaction has caused.
Fight to win the war! We will win (both scenarios include an up-down). This battle can be won by letting the enemy manuver itselt into a corner that has no face-saving exit.
Remember the 1995 budget impasse and the long-term impact on the Republicans?

You were not necessary the person who started it, someone with spuds in his/her name did. We are refuting it. That's all now is not the time to go "wobbly" on our Majority Leader. We are in the heat of the battle.
