I noticed that as well, they were bound and determined to block the beginning of this session I was proud of Sam Brownbeck for ruling Kennedy out of order! I was proud of Frist for not caving! Go GOP!

Rush-moderates don't run show. can clog up proceddings, but cannot determeine whether vote will be taken. This is true.

I thought it was the checks and balances part of the Constitution that gave Congress the job of overseeing the Judicial branch. Congress makes all federal courts, except the Supreme Court, which was created by the Constitution.
Congress has advice and consent oversight for Supreme Court judges (nominated and appointed by the president), under the Constitution. Congress may, under the Constitution, give the president the power to appoint lower court judges without any advice & consent oversight.
Congress has the power to impeach and remove judges who fail to exercise good behavior. That is a term of art that means whatever the political body of Congress wants it to mean.
"Checks and balances" is a general term that embodies the various details of power granted to each branch of government. There is no particular "checks and balances" part. ;-)
