Court rejects gay-lesbian group's appeal

GRETNA, La. (AP) — A state appeal court has refused to strike down the state's crime against nature law, which bans sex with animals, among other acts.

In addition, the Louisiana 5th Circuit Court of Appeal rejected an attempt by LEGAL, the Louisiana Electorate of Gays and Lesbians, to throw out a law that says the state attorney general can investigate homosexual organizations.

In one of the two provisions LEGAL was trying to strike down, the state attorney general's office is given the right to prosecute homosexual groups, as well as those promoting prostitution and narcotics. The categories are all lumped together in the elderly statute.

But the appeals court said, in effect, that LEGAL's target — the Jefferson Parish district attorney — was not properly chosen, and that it could, if it choses too, go after the attorney general on the same issue.

"Nothing in this decision prevents the plaintiffs from proceeding directly against the attorney general," the three-judge panel said.

In the other challenge ruled on by the appeals court, LEGAL sought to have the state's entire crime against nature law struck down.

Last year, Judge Robert Murphy of Jefferson Parish followed the U.S. Supreme Court by striking down part of the law making it criminal for consenting adults to have oral or anal sex.

But Murphy left intact parts of the crimes against nature law forbidding human sex with animals, solicitation for oral and anal sex, and aggravated crimes against nature — aggravated usually meaning nonconsensual sex or sex involving someone who is underaged.

LEGAL didn't object to having those activities declared illegal, but held that Murphy had improperly whittled down the original law — and that throwing the entire statute out was preferable.

In their ruling this week, the appeal court upheld Murphy.

John Rawls, LEGAL's attorney, vowed to press on. "It's like swimming in jello. This is the 14th appelate court we've gone to," he said. "If the judges of this state think they are going to wear out the gay and lesbian community, the judges are mistaken."

Sex with animals can be banned? Don't see how based on the recent Supreme Court sodomy case.

They just didn't like the legal procedures used and it has nothing to do with an agenda to strike down any law dealing with sexual perversions.

I don't know what they are being investigated for. I made a quick search of the Louisiana statutes using Findlaw.com, but I could not find any relevant statutes containing the word "homosexual."

If any of you are familiar with this law, please let us know. I would really like to read the statute.

AH HA! the truth is burried in the end of the article. (no pun intended)

The goal of the homosexuals was to eliminate the statute so it would be legal to have sex acts with non-adults. As usual homosexuals want sexual access to children.

As far as I can tell, they are not being investigated. They just don't want it on the books that they CAN be investigated. Sounds to me like somebody just wants their group's name in the news.

The other groups are not advocats of lowering the age of consent.

The other groups do not demand training children in homosexual sex before the age of majority. (see Fisting scandals with GLSEN)

The other groups do not have their stated purpose of advocating recreational sex for minors.

There is the issue the homosexuals have their real focus. Underage means not adult, not just above the age of consent. Thus if an adult has sex with a 17 3/4 year old, they are still subject to arrest and placement on the sex predator list. More poinient now that sex predator lists are going to be longer if not permanent.

Just checking. The law says that the government can investigate all homosexuals groups? Or just the one you refer to?

I think I may have found it. I suspect they are referring to this Louisiana statute, which I reproduce in full below.

CHAPTER 13.  MISCELLANEOUS PROVISIONS APPLICABLE

TO MORE THAN ONE KIND OF CORPORATION

§1041.  Suppression of criminally operated businesses by domestic and foreign corporations; proceedings

A.  The attorney general is authorized to institute civil proceedings against any domestic corporation to procure a judgment annulling, vacating or forfeiting its articles of incorporation and franchise, and against any foreign corporation to revoke its certificate of authority to transact business in this state when:

1.  Any of the corporation officers or any other person controlling the management or operation of such corporation, with the knowledge of the president and a majority of the board of directors or under such circumstances that the president and a majority of the directors should have knowledge, is a person or persons engaged in activities such as organized violent revolutionary or unlawful activity aimed at the overthrow of the government of the State of Louisiana or any of its political subdivisions, or any boards, commissions, agency or official of either, or any unlawful activity aimed at organized homosexuality, organized crimes against nature, organized prostitution, organized gambling, organized narcotics, organized extortion or organized embezzlement, or who is connected directly or indirectly with organizations, syndicates or criminal societies engaged in any of these; or

2.  A director, officer, employee, agent or stockholder acting for, through or on behalf of such corporation has, in conducting the corporation's affairs, purposely engaged in a persistent course of violent revolutionary or unlawful activity aimed at the overthrow of the government of the State of Louisiana or any of its political subdivisions, or any boards, commissions, agency or official or any unlawful activity aimed at homosexuality, crimes against nature, intimidation and coercion, bribery, prostitution, gambling, extortion, embezzlement, unlawful sale of narcotics or other illegal conduct, with the knowledge of the president and majority of the board of directors or under such circumstances that the president and a majority of the directors should have knowledge, with the intent to compel or induce other persons, firms or corporations to deal with such corporation or engage in any such illegal conduct, and

3.  For the prevention of future illegal conduct of the same character, the public interest requires the charter of the corporation to be annulled, vacated or forfeited and the corporation to be dissolved or the certificate of authority to transact business in this state revoked.  

B.  The proceedings authorized by this section may be instituted against a corporation in the district court for the parish of its registered office or for any parish in which it is doing business.  The proceedings shall be conducted in accordance with the Louisiana Code of Civil Procedure and the applicable rules of court.  

The proceedings herein authorized shall be in addition to any other proceeding authorized by law for the purpose of annulling, vacating or forfeiting the articles and franchise of a domestic corporation and/or revoking the certificate of authority of a foreign corporation to transact business in this state.

Note: If sexual deviants of various stripes kept their unsavory proclivities to themselves, in the outhouse where they belong, no one would know, and therefore no one would care.

What we object to is having sexual deviance shoved down our throats, our kids' throats, our grandparents' throats, and our grandchildrens' throats. Leave us be, and we'll leave you be. Got it?
