If that's the case, then why did MS petition the court for an order declaring Terri could only receive communion twice (and stipulate WHO could give it to her), for permission to retain custody of Terri's body after her court ordered death and permission to have her cremated?

Butt-covering, basically - if he's got an order in hand, then any challenge from her family is DOA.

I certainly hope you're right. I avoid most of them. They don't debate, they humiliate and cut down anyone who disagrees with them. They are armed with one line zingers they throw like daggers.

What the heck are you talking about? She did have a guardian. He was in dispute, but he filled the bill as far as the law was concerned and was not a battling "they".

What's the guardian supposed to do with respect to our new requirement for perpetual counsel? Or are we proposing that all incapacitated persons get permanent counsel who will act as their legal guardians as well?

He does things outside the court. What is so hard about that? I am my blind and mentally handicapped daughter's guardian. I attended special ed meetings. I attend her group home meetings. They call me whenever she has problems at work. I am not her attorney.

LOL. Well, then, I guess you'd better explain how your Probate Attorney's Full Employment Act will create an "interested person who may reasonably be expected to be directly affected by the surrogate or proxy's decision". And assuming we get through those rapids, we can then contemplate the practical day-to-day effects of the scheme you're proposing. Basically, every incapacitated person automatically gets a court-appointed attorney, which, of course, the state will have to fund. Then, even better, that court-appointed attorney, a complete stranger to the family, now has effective veto power over the legal guardian by virtue of the fact that they're empowered to tie the guardian up in court from now until the end of time. Well, hell - why didn't you just say so? That's just the sort of intrusion that people will welcome with open arms, I'm sure. LOL. I think you should write your congressman and your state rep with that plan, and see if they don't drop it like a hot rock.
