Hours after a judge ordered that Terri Schiavo was not to be removed from her hospice, a team of state agents were en route to seize her and have her feeding tube reinserted -- but they stopped short when local police told them they would enforce the judge's order, The Herald has learned.
Agents of the Florida Department of Law Enforcement told police in Pinellas Park, the small town where Schiavo lies at Hospice Woodside, on Thursday that they were on the way to take her to a hospital to resume her feeding.
For a brief period, local police, who have officers at the hospice to keep protesters out, prepared for what sources called ``a showdown.''
In the end, the squad from the FDLE and the Department of Children & Families backed down, apparently concerned about confronting local police outside the hospice.
''We told them that unless they had the judge with them when they came, they were not going to get in,'' said a source with the local police.
''The FDLE called to say they were en route to the scene,'' said an official with the city police who requested anonymity. ``When the sheriff's department and our department told them they could not enforce their order, they backed off.''
The incident, known only to a few and related to The Herald by three different sources involved in Thursday's events, underscores the intense emotion and murky legal terrain that the Schiavo case has created. It also shows that agencies answering directly to Gov. Jeb Bush had planned to use a wrinkle in Florida law that would have allowed them to legally get around the judge's order. The exception in the law allows public agencies to freeze a judge's order whenever an agency appeals it.

Have you changed your mind on that?
I think religious people do not so much get upset at reasoning not supported by biblical reasoning (ie silent on the issue) as they get really mad at reasoning that goes directly against biblical teachings (ie direct command) ex. do not kill the innocent.
Christ had told them explicitly that he had to be captured. Note that He did *not* tell Peter he was wrong to have a sword! (In fact earlier Jesus told him that it was a suitable weapon.) So in that case, Peter was wrong because of explicit revelation otherwise.
God has NOT told us explicitly that Terri has to be held in the hell-clutches until she dies. Only those who want to be complacent in the time of evil.
"ah yes......cowards and traitors....name calling is so effective......"
So, you would rather use force? Force must be avoided and used only as a last resort and where appropriate. It is yet not appropriate nor is it the last resort. The President or the Governor still have the options of issuing an EO or send in the federal marshalls or state troopers, but this should have been done days ago. Now time is running out and the President or Governor must resort to the last resort, I think.
I'll start worrying about that... sometime...
Very good analysis. JB is still in a bind and I would not want to be in his shoes.
There's nothing in the constitution about his hands being tied when "ruled upon by judges" when those judges' rulings are illegal. The court's only recourse is to try to impeach him for it, and it's the Legislature which would judge that. A Legislature which has little humor for the runaway courts of Florida.
I believe you've taken one of the most magnificent ideas ever and turned it into a cliche.
haha.......in my case wine.....gee, I'm already a Nazi and now a heathen tonight.....this thread turned faster than a little girl's head at an exorcism
"Fortunately, we have a trump card up our sleeves---God Almighty. When courage is called for, He provides it assuming the vessel is willing."
Beautifully put.
Thank you.
The question becomes...WILL they do it? Call me cynical, but I won't hold my breath.
The pro-murder side of the Republican party is execrable.
Why should I continue to support a party that welcomes this evil?
So you are cool with the state murdering helpless people?
Look, if Jeb defies the court on the grounds of Florida law, it is the Legislature, NOT the court, which will be the body that tries him on the issue. You know, checks and balances?
Nah, she will never lose, because she is a true American who has heart and integrity. She believes in what's right, and fighting for what's right.
You need to put your money where your big mouth is, and change things, so we don't have another Terri situation. Do you live in Florida? Do you go out and work for your party, to try to make sure the ones deserving of making these decisions are elected? Have you walked the streets, made the phone calls, and worked for Conservative officials to be elected?
Or are you just sitting there all comfy and cozy, making judgements?
I am very active in our local Republican party. I suggest you get off your kiester and do the same, so we can change things.
The liberal judges in FL have done everyting they can to seal Terri's fate.
I, for one, will work to see that a scenerio such as this doesn't happen in my state.
"Yes, it is tragic that a woman is getting railroaded by a runaway activist judge, but.."
Let's at least you the correct terminology, a woman is being starved to death, not railroaded.
Just like, 'we are only relieving her of 'nutrition and hydration' NO, they took away her 'food and water'.
You mean back to when conservatives were conservative? Great let's do it.
