Police 'Showdown' Averted ['Team of State Agents Were En Route to Seize Terri']

Hours after a judge ordered that Terri Schiavo was not to be removed from her hospice, a team of state agents were en route to seize her and have her feeding tube reinserted -- but they stopped short when local police told them they would enforce the judge's order, The Herald has learned.

Agents of the Florida Department of Law Enforcement told police in Pinellas Park, the small town where Schiavo lies at Hospice Woodside, on Thursday that they were on the way to take her to a hospital to resume her feeding.

For a brief period, local police, who have officers at the hospice to keep protesters out, prepared for what sources called ``a showdown.''

In the end, the squad from the FDLE and the Department of Children & Families backed down, apparently concerned about confronting local police outside the hospice.

''We told them that unless they had the judge with them when they came, they were not going to get in,'' said a source with the local police.

''The FDLE called to say they were en route to the scene,'' said an official with the city police who requested anonymity. ``When the sheriff's department and our department told them they could not enforce their order, they backed off.''

The incident,known only to a few and related to The Herald by three different sources involved in Thursday's events, underscores the intense emotion and murky legal terrain that the Schiavo case has created. It also shows that agencies answering directly to Gov. Jeb Bush had planned to use a wrinkle in Florida law that would have allowed them to legally get around the judge's order. The exception in the law allows public agencies to freeze a judge's order whenever an agency appeals it.

I am not "judging" the Bush's, Greer, any number of people, etc. God's word is busy judging them right now.

And you're statement is not awkward? It is natural AND logical that we demand action when Terri is being starved by court order. I would be proud to be such a "usual wingnut." I only wish I had taken some concrete action instead of believing the legal process would finally get it right.

So since there was nothing that the German Church could do to stop the Holocost, then they fulfilled what God required them to do? Really? Last time I checked, the Germanic Church condemned itself after the war. It basically said that for each Jew getting on the train to the Death Camp, a Christian should have joined him.

Instead a few did great things, but most did nothing, but I am sure that is alright, because there really wasn't anything against the law they could do. So God will understand.

This is all well and good but Congress enacted a law that said to the Federal Court: do a trial de novo of this matter.
The Courts did not say that the Act was unconstitutional which is their rights.
They said we won't do the trial de novo,because we won't keep Terri alive in order to have the trial.
Now you can pray, and change the law,all you want if the courts won't obey the law,then you get this situation.
No matter how you slice it,Whittemore through Scotus disobeyed the Constitution themselves.
So who gets to tell whom about who broke the law.The Executive Legislative or the Judiciary .And who gets to do something about it.
When these clashes happen,there is always trouble.

A So-Called Christian is somebody who hides behind that label to justify his/her intolerance for other people and their views. Generally, they froth at the mouth and claim that the Bible takes precedence over secular laws. When they discover that someone like me, an atheist, has the nerve to post something that they don't like, they generally go ballistic and it gets personal. Then the postings turn into something other than what the subject is about. So-called Christians thrive on persecution and find it wherever they look. Clear enough?

The Governors of all 50 States do not need court orders in order to exercise their Executive power.

Executive power for taking a person into protective custody - Jeb Bush could use it, but the application is generally reserved for such occasions when the public at large is in danger or the public interest is "compelling" in the face of some threat to the public.

Presently, the public is not in danger, and the view of people in the area has appeared to be that they are not largely compelled to petition the governor to act. It seems the opposite, that they wish it all done.

Now, let us suppose that a large crowd did show up near the hospice and they moved on the hospice. Jeb Bush could then take Terri into protective custody, but that does not mean that he necessarily could feed her, though he might provide some water.

Generally, the governor needs a situation where protective custody is applied in order to preserve information necessary for, again, the public safety.

The problem is, that the public is not at risk; rather, they're bored.

There is not much Jeb Bush can do, while Terri is alive, but he may enforce the State's compelling interest to resolve whether or not Michael Schiavo abused Terri. He most definitely has the power to prevent the cremation of Terri Schiavo.

The question is, still, would he?

He should probably have the body scanned and a new team of radiologists examine the scans, for signs of proceeding. If they are more than mildly impressed that there are signs of bone damage that are good enough for a go ahead, then there may be an autopsy.

It is in the interest of public safety; and Governor Bush can seize the body. All along through each step of the preliminary investigation, Governor Bush has to judge the probability that the investigation will proceed further and reveal enough information to point the finger at Michael Schiavo, the prime suspect, and take it to a grand jury.

At any point where Terri's bones do not "speak" well enough of Michael's abusing her, the investigation is over, and the body is returned to Michael Schiavo, so that he may proceed with the cremation.

Some unjust laws can, and should be, disobeyed. Our declaration of independence gives us the right to life and it's unjust and immoral not to uphold that right by any means. We are just slowly allowing this country to fall apart by our years of inaction. We won't use this to change anything next time around. We always say we will but we just slowly become a more liberal nation with less values.

Does it matter? Let everyone who wants to examine her, do so for a month. Bring in 100, 1000, 10000, neural surgeons. Whatever happens; at least we will be dealing with something more pursuasive then a fuzzy catscan from 1992.
