Schindlers' Options Dwindle to Hearing Tonight with Federal Judge (Motion DENIED)

A federal court hearing has started in one of the last effort attempts by Terri Schiavo's parents to restore their daughter's feeding tube.

But the judge already has turned down the parents once. Bob and Mary Schindler are asking for an emergency order to reinsert the feeding tube in the brain-damaged woman.

The hearing in Tampa is before U.S. District Judge James Whittemore. He turned the Schindlers down once, as did a federal appeals court and the Supreme Court. A state judge, a state appeals court and the Florida Supreme Court also have all come down on the side of the husband, who wants to let his wife die after 15 years in what some doctors call a vegetative state.

The latest defeat for the Schindlers was today when a state judge said he won't go along with Governor Jeb Bush's request to order the feeding tube reinserted. The governor had said that new allegations of abuse of Terri Schiavo need to be investigated. The governor also tried to challenged the diagnosis that Terri Schiavo is in a persistent vegetative state.

Wish everyone could have heard Judge Bork on Hannity today. He was very good and laid the cards on the table that the SCOTUS never was going to take this case and if he were there he would have voted against because this is about one woman and if the SCOTUS took every case about one individual they would have no time to rule on anything. They do not want to set a precedent in such a narrow case dealing with one person.

If anyone wants to really know what is wrong -- look to the laws passed by the State Legislatures and to the people who reelect Judges like Judge Greer. Then while you are it ask yourself why the team of lawyers for the family according to a lot of lawyers border on incompetent in their pleadings.

This should wake people up to get involved in seeing what your Legislature passes and if you don't like a judge, get people organized and work for their defeat.

We have become complacent as a Nation and allowed the liberal judges to become activist judges. Now some of you want the President or the Governor to break the law and the judges to be activists in the Federal system because of the wrong that Judge Greer has done to Terri. We cannot have it both ways.

Either we are a Nation of Laws and we work to change bad laws and defeat Judges like Greer, or we become a Nation where the President or Governor can break the law when we think it is okay and favors our side but is bad if they break the law the other way. The same is true of wanting activists judges that are okay when they rule like we want and bad when they rule the other way.

This Nation is over 200 years old and faced many crises much worse than this one and survived. It is up to everyone on this board to become involved in their States to change the laws and defeat judges like Judge Greer. We need to make sure that something like this cannot continue to happen in this Nation. According to Judge Bork it happens all the time.

The judge ordered a restraining order and if DCF tried to go in there they would be arrested on the spot.

You probably misuderstood the news report.
Maybe they were just running through what could happen IF DCF went in.

Wonder if the parents will bring a civil suit against someone when this if over (Michael, Greer, Whitmoore?
May very well be able to find a very sympathetic jury!

CNN up here has highlighted several soldiers who received horrible injuries in Iraq.

This will only get worse if we start down this road.

There have been a number of hits on this now, of course, with TV proving to be the most outrageous.

I concur with Rush Limbaugh on this point about the press taking snipes at people of our bent on this. They see this as an opportunity to stick it to the so-called "Religious Right"/Right to Life crowd by forcing us to watch this woman die. They think it will demoralize us and therefore lead to a resurgence of liberal power. Apparently, reports on the blogosphere are increasingly painting hte picture that lib operatives faked a "GOP Insider" Memo that insinuated that the GOP did all of this to kiss up to the "Religious Right" as well. PowerLine is on the case, and I am sure lots of others are. I can only do so much.

I disagree that it will succeed, but they obviously have a dog in the hunt and an axe to grind with the "Religious Right", whom they feel are the only people responsible for reelecting the President.

This was all about politics from the beginning.

I am pretty cynical, so my bet is that the AP will come back for thirds and fourths, frankly. They think they own this country, and we are all a bunch of holy-rollin' Hicks from the South who've come to DC to remake the USA into the CSA. The condescension is obvious.

Gov Jeb Bush is doing and has done as much as he can - They have the smartest lawyers and scholars looking at all "legal" actions he can take as Florida Gov.

People should not try and put the blame on Jeb Bush - That is simply wrong - This man has done more for Terri than anyone else (including Terri's own family and her family attorney's who by all accounts did a terrible job throughout the early trials within this case).
