Shiavo's lawyer has been spouting like he was accepting an Academy award or something. He has been chiding the "Executive Branch".
Just been asked if he will take action against Bush..says it would be kidnapping as there is no other legal way to get her. The gauntlet has just been thrown down!

They will not act. Don't build up false hope. As President and Governor, they must act within the law.I agree that they will not act to rescue her, but only because the pretext of acting 'within the law' (whatever the heck THAT means) gives them cover to not do what they should do.

Someone posted that a NYTimes reporter has information that Greer has ordered police or the National Guard to prevent Jeb Bush from taking Terri. I couldn't find that post after a few minutes, and so can't see if that were true or just an inflammatory troll, as it appears to have disappeard, unless someone can find it. If true, that goes beyond separation of powers.
Other than that, I can't post here, as we are not to incite violence if we wish to continue to post.

Are you saying that Wilson's dissent was poorly reasoned and that Whittemore could not have ruled the same thing? Did the parents not provide the text of the statute to the District court and the appellate courts? If so, if the courts read it, they would see that it was their duty to review the facts de novo, and to do that, it was necessary to keep the subject alive long enough for that review to occur.
The only other option available to any jurist who read the law would be to declare it unconstitutional. Even had they done that, it would have been prudent to grant a stay, as the issue of constitutionality is a matter of law that would be subject to review de novo by the appellate courts.

I'm afraid that won't matter. Greer has ruled that the tube MUST COME OUT and now STAY OUT. Even if Schiavo has a miraculous change of heart, it's done. He, himself, can't have the tube replaced.
