Michael Schiavo Files Request With the SCOTUS, USSC Refuses to Take Schiavo Case

Michael Schiavo has filed a petition with the Supreme Court asking them to stay out of the case.

Do you mean her current state of starvation or just her incurable condition generally?

Don't know who was calling the shots on the legal team for the Federal Courts, but they are at fault on this as well while an innocent woman is starved to death.

The unanimity of legal talking heads from across the political spectrum shaking their heads in disbelief at the pleadings spoke volumes. The feckless performance of the legal team will gnaw at many of us for years to come.

Was that before or after they got the $1 million settlement? If before, that would be the kind of thing that a plaintiff would do to inflate the settlement. You generally ask for about 3 times the meds, plus, in this case, future loss of income, plus, future meds. So, plaintiffs lawyers pull out all the stops to get high medical bills since they get a 3-fold return on them.

The Declaration of Independence permits the people to overthrow the government when it becomes oppressive and unresponsive.

That refers to a matter of conscience not law but I think our government has forgotten that. Or they don't think it can happen.

Let's take the recent reactions to two different cases by FReepers into consideration, shall we?

FReepers called it Judicial tyranny when a Court overturned the Texas sodomy law, and claimed that the law was duly enacted by the Texas legislature, and the Courts had no power to overturn them, and that only the legislature had the power to do so.

Now, FReepers are upset that Florida Courts are acting in accordance to the laws of the State of Florida as enacted by the legislature, and not in fact adjudicating in accordance to whether or not they agree with those laws.

Which way do we want to go here?

Should the Courts wait to perceive how the people "feel" about the laws, and to how they apply to particular cases before rendering decisions?

I'm absolutely terrified as to what this will mean for us. The bar to having the plug pulled is substantially lowered. Suppose, for instance, someone had a stroke and couldn't speak. A relative who overheard that person saying they didn't want to live under these circumstances, is enough to have that person's life support - even if it is just food and water, taken away.

Why don't we channel some of our righteous anger into bigger issues? UN corruption has killed thousands of people, we could start there.

Indeed. Rather than walking away in disgust over what people might have done - a lot has been attempted at all levels - freepers need to take on a relentless determination to make a difference in the judicial appointment processes . This whole case brings the US Senate stalemate on GWB's judicial nominations into clear focus as a MUST WIN against judicial activism (read: tyranny). No rancor, no public outbursts, and certainly no violence, just a resolve to never forget nor give up.

Unfortunately the pleading they were given to make a determination, I would have had to rule with them. Will more people realize that the pleadings to Federal Court were wrong or am I talking to the wind for the most part. The Feds ruled on what was before them -- end of story!

Jeb is a Catholic. If there is a possibility he can still intervene, in concert with the Federal Government, he may invite a nasty impeachment and ruin any chance at the Presidency, but such a sacrifice would earn him treasure in heaven untold... Moral law trumps civil. He has a duty to be disobedient to the judiciary if his conscience dictates they are committing a moral crime and he holds power to circumvent...
