State officials say they are considering removing Terri Schiavo from hospice, by force if necessary, despite numerous court orders upholding the removal of the artificial nutrition tube that has kept her alive for 15 years.
Lucy Hadl, secretary of the Department of Children and Families, said Wednesday morning that her staff is relying on a state law that gives the department the authority to intervene on behalf of a vulnerable adult who is 'suffering from abuse or neglect that presents a risk of death or serious physical injury.'
Hadl said that the DCF would have to file a petition in order to remove Schiavo, but that 'it doesn't mean we'd have to have judicial approval in advance of taking the action if we believed it met the threshold for doing it.'
Hadl said that seven years of court rulings backing Schiavo's husband Michael, in his contention that Terri Schiavo did not wish to be kept alive artificially would not stop the DCF from taking action.
'We're not compelled to look at prior judicial proceedings,' Hadl said.
What we are compelled to look at is the presenting circumstances and any allegiations of abuse and neglect that we have recieved. So we have to deal with those and fufill out statutory responsibility.'

As an aside, I wonder who's picking up the tab for all that police protection at the hospice?
I don't think so either. But I have to wonder why they've even issued such a statement.
Makes me think that:
a)They really mean it....least likely I think.
b)This is a show down, literally, of the judiciary and the executive branch. The statement is part of the grand bluff.
c)They don't mean a word of it and are just covering their bureaucratic butts.
I'd go with B. Everything done to date is bluff stuff. Issuing the congressional subpoena, hinting that Florida's DCF would get involved. I think last weekend's congressional action was NOT a bluff. But the other things were done to creat a bluff.
In the end I do not see armed guards going in and kidnaping Terri.

What order exactly would they be in contempt of?
IF this happens, I pray it's in time for Terri.
I have a disturbingly persistent feeling that Terri would die on Good Friday. I hope that's just a result of upset over this entire thing.

We may, however, witness a showdown in the Hospice parking lot between local cops and the state cops.
I may have misunderstood, but from what I have heard on Sean Hannity's radio show, I think DCF got a call from a Mayo Clinic doctor (a "renowned" neurologist), who has examined films, records of Terri and thinks she is in a state of "minimal consciousness", rather than a "persistent or permanent vegetative state".
No crisis...this how the balance of powers should work
I am guessing the DFC is part of the Executive branch...so the Executive branch of the state government ignores the court ruling...the judicial branch may (or may not) request that the legislative branch intercede (the threat of impeachment of the governor would be the extreme intercession) and either the legislative branch follows or ignores the judicial branch
the balance of powers playing out...its a beautiful thing...I wish more legislatures and executives had the guts to say to the courts..."no...you're not the final word on every issue...we are co-equal, not subordinate branches"

To cover themselves, all the way to Jeb. It gives the impressions that they tried to stop the starvation (killing), but the courts (judges) stopped them.
