State officials say they are considering removing Terri Schiavo from hospice, by force if necessary, despite numerous court orders upholding the removal of the artificial nutrition tube that has kept her alive for 15 years.
Lucy Hadl, secretary of the Department of Children and Families, said Wednesday morning that her staff is relying on a state law that gives the department the authority to intervene on behalf of a vulnerable adult who is 'suffering from abuse or neglect that presents a risk of death or serious physical injury.'
Hadl said that the DCF would have to file a petition in order to remove Schiavo, but that 'it doesn't mean we'd have to have judicial approval in advance of taking the action if we believed it met the threshold for doing it.'
Hadl said that seven years of court rulings backing Schiavo's husband Michael, in his contention that Terri Schiavo did not wish to be kept alive artificially would not stop the DCF from taking action.
'We're not compelled to look at prior judicial proceedings,' Hadl said.
What we are compelled to look at is the presenting circumstances and any allegiations of abuse and neglect that we have recieved. So we have to deal with those and fufill out statutory responsibility.'

As I said on another thread.. I believe the case will go on way beyond her possible death. She has already exposed the height of corruption that condems her and it is ugly and there are many linkages.. Save Terri..

DCF is responsible for any action taking Terri into protective custody. They don't act at the Governor's behest.

I'm not a lawyer.....but I can ONLY assume Jeb Bush, as Governor, can OVERRULE.

I don't know what happens at that point. If the executive branch, and presumably the legislative branch, are free to ignore court rulings, then the Rule of Law has been greatly weakened.
Maybe that's a good thing because the judiciary has become too powerful. But maybe it will lead to chaos. Governors and Presidents can do whatever the heck they want without anyone having any recourse. And if they can flaunt the laws and judicial decrees without any fear, why can't the people?
I dunno, I think this has consequences far beyond Terri, and Jeb Bush had better think about it before he does it.
Okay, that makes sense. Thank you for the answer...so there may still be hope that she can be taken into state custody...or some safer custody.

That's inaccurate. Michael, his brother and his brother's wife said that. Less than 20 judges said, "Well, if you say so".
There have been LAWS BROKEN by Greer which would NULLIFY Greer's orders.
The consequences are there, and just as bad if they don't act.

I guess you are the anti-Terri side.You are so brave probably sitting their with your 4 course meal in front of you with plenty of liquid. The anti terri side tells everyone that they think handicapped people are disgusting and not worth living. You also think it is ok for an abusive husband to render his wife in that condition,sue the hospital,piss the award money away on Felos,and after you have spent the money dump her off on Hospice so you can have sex and bear two children out of wedlock while you are shacking up. You then must feel it is ok to let that same filthy degenerate 6ft7inch bully be her guardian ad litem and insist that she die. You have the potentional to be a liberal demoncrap if you are not already. I would not want you to baby sit my alligator.
