State officials say they are considering removing Terri Schiavo from hospice, by force if necessary, despite numerous court orders upholding the removal of the artificial nutrition tube that has kept her alive for 15 years.
Lucy Hadl, secretary of the Department of Children and Families, said Wednesday morning that her staff is relying on a state law that gives the department the authority to intervene on behalf of a vulnerable adult who is 'suffering from abuse or neglect that presents a risk of death or serious physical injury.'
Hadl said that the DCF would have to file a petition in order to remove Schiavo, but that 'it doesn't mean we'd have to have judicial approval in advance of taking the action if we believed it met the threshold for doing it.'
Hadl said that seven years of court rulings backing Schiavo's husband Michael, in his contention that Terri Schiavo did not wish to be kept alive artificially would not stop the DCF from taking action.
'We're not compelled to look at prior judicial proceedings,' Hadl said.
What we are compelled to look at is the presenting circumstances and any allegiations of abuse and neglect that we have recieved. So we have to deal with those and fufill out statutory responsibility.'

I won't go join the protest this time. But I did go to Washington D.C. from rural NM last fall to join in a veterans rally against Kerry. And I would probably be on the line if I lived in Florida.
And don't DARE play the sympathy card with me.
If the Governor says he has the authority to act, but doesn't, what does that say about him? If he remains silent with respect to his authority (which he knows he has), but rings his hands like Pontius Pilot and does nothing, what does that say? No, if he has such authority but does not exercise it in this life and death issue, he loses my respect
Law and Ethics are two completely unrelated subjects.
Greer would. He's got to cover his butt. If she dies, he and Schiavo should both be hauled up in front of a grand jury.

I've had that same feeling about her dying on Good Friday. I pray we're wrong.
And what does this say about the citizens of Florida that they're allowing this to be done in their name...?
"Some unknown judge is now the governor of Florida."
This conjures up the image of warring groups of police, one trying to enforce the judge's ruling and one trying to enforce the governor executing laws...it seems to me the judicial branch is trying to go beyond its role and become not only the legislative but the executive branches as well...
It is my earnest prayer that DCF gets Terri out....gets her hydrated and fed....and she is stabilized.

I used to be proud of my country and respect what it stood for. Apparently starving a disabled person is the law of the land. Lord help us all.
That should tell us that he is damned and determined to see that Terri dies no matter what evidence there is of being wrongly diagnosed!
Judge Green does not take into account "natural law", only statutory law.

I heard that too. Now what? I guess I didn't think that could happen. I am not legally savvy at all..just following the story extremely closely and was so encouraged after Jeb's press conference this afternoon.
Why, why are they still asking the Court? Jeb Bush should sign an executive order. The Republican party is going down the tubes, so why should he be afraid to act. He does not need the approval of the Legislature since there are three branches of government, even in Florida. He has the right of executive order without the approval of the court or the legislature.
