Tonight it is, March 22, 2005, over five days since Theresa Marie Schiavo commenced her ordeal of purposeful and legally sanctioned dehydration and starvation. We await a decision from the three judge panel from Eleventh Judicial Circuit as to her fate, as her family struggles with seeing Terri's physical health deteriorate.

This morning the radio said there is 9 fl state senators (I believe democrats) holding up new FL legislation which would outlaw death by removing food and water when there is no artificial support like a machine of some type.

Oh dear God- what have we come to when children are getting arrested trying to take water to a dying woman- one who has committed no crime, has no desire to die and may very well be the victim of a crime.

Hang on, if there is a conflict between family members, then the court would hear evidence and make the decision. (That means Greer gets to decide? That's what he's already done.) "You're not willing to accept multiple courts on this case. Not making the decision that YOU want."

Sections 12101 provides that necessary and appropriate rehabilitation services and physical/motor skill therapy may not be denied a substantially disabled patient in the United States of America. Cf 28 CFR, Ch 1, Subpart B, Sect 35.130 States Nothing in the Act or this part authorizes the representative or guardian of an individual with a disability to decline food, water, medical treatment, or medical services for that individual.

this is on standing in the court for any family member to be heard, and for end of life wishes not to be carried out -- webster:
sen bennet -- I"m having a hard time w/this -- if there's a conflict, you want the courts to decide? webster: only if this is BROUGHT to the court. bennet -- ? webster -- court would have to decide if there is a conflict.
bennet -- how many courts for Ms. Schiavo? webster -- my desier is not to take on the court . what I've said is, our job is to SET POLICY. the level of evidence we're requiring is a higher level than what was used in this case. it is up to the court to determine if they have reached this threshhold, if there's a conflict in the family, in this rare rare situation.
