Tonight it is, March 22, 2005, over five days since Theresa Marie Schiavo commenced her ordeal of purposeful and legally sanctioned dehydration and starvation. We await a decision from the three judge panel from Eleventh Judicial Circuit as to her fate, as her family struggles with seeing Terri's physical health deteriorate.
he posted earlier you may need to be a lawyer to get in.....i don't think it's available to the general public.
Thank you for at least that information. I have asked like...5 times for the info or link to see what context on the court docket it is posted.
If the date is the 21st, with no ruling date of the 22nd, then you can pretty much guess that it is the file information sent down from Whittemore's.
At times like this it helps me to remember the many prayer victories we've experienced together on FR. A good example is the 2000 Election. Our God is faithful.
What was the screen name of the lawyer that was on the other night? Can yall ping him/her?
I think she gets fed! They way I read it, "vacated" means that Whittemore's ruling is nullified and "remanded with instructions" means it goes back to Whittemore's court with orders that he make a particular ruling, probably to insert the feeding tube.
Judgment of the district court is Vacated and Remanded with instructions; Application for COA Granted In Part & Denied As Moot In Part; Motion for Injunction Denied Without Prejudice; Mandate issued immediately. (EEC/FMH/CRW)
The denied as moot in part could mean that because the Moody motion was to keep the tube in and it was already removed, that makes that part of the motion moot...just an educated guess
It now seems that this court has been dealing with other business, not just Terri. So our temporary optimism may again be unwarranted.
Amen to your prayer!
I think this information is premature and the wrong ruling...
the 11th hasn't ruled yet. I believe the information we are seeing is based on the file information sent from Whittemore's court.
Who is Moody?
I was only aware that the case went before one Fed Judge so far...Whittemore.
If Michael has to answer Gibbs' questions without Felos answering for him, it will become so obvious to everyone that Terri isn't PVS that it won't matter what the judge decides.
It now seems that this court has been dealing with other business, not just Terri. So our temporary optimism may again be unwarranted.
Good point, remember, when our side files something, the loser's side is doing the same...
OK, it's PACER. Sorry for getting hysterical.
Scott Schiavo says his brother has been with Terri day and night. How does he have time for that other family? He must be such a Superman!
You can if you register and you have to pay to search.
COA ='s certificate of appealaboity.... mandate ='s court certified order
You may be right, but this is from the 11th circuit, not the district court for the middle district of florida. I will try and go THERE and see if there is anyting, which is not likely. They probably don't post this late.
SCOTT SCHIAVO is on Greta NOW. He is upset about all the awful things people say about Michael, when Michael has been at Terri's side day in and day out.
Whittemore won't be able to kill her, I don't believe because of the jury and the publicity that the case will generate. I just hope she gets the justice due her, but I am still skeptical of the American system.
