How stupid. How can there be a de novo trial later if there is no relief granted? What a deceitful judge.

He had already decided to murder her.

More to the point, if there were major revelations it would embarrass the democrat death party that's been pushing for her to be put down asap. Therefore, Terri hasn't a chance of having anything beyond what the Greer degeneracy has established being aired. And I ask those silently please that the Congressional action has failed to save Terri (not you TR): What would you say as Terri dies if there is evidence that Terri is not in PVS, has been abused via forced neglect for a decade, and the Greer court has broken conflict of interest rules repeatedly? ... I know, you'd say, "Well, she's dead Jim. Move on, there's nothing to see here."

This was merely a hearing on providing injunctive relief.

Without which the de novo trial will be moot.

The de novo trial comes later. It appears that what Congress was expecting was that the Court would grant relief and then later -- probably after months of preparation -- there would be a lengthy trial. Congress did not anticipate that the judge would not grant relief based on the premise that the Schindlers would likely not prevail during the trial. I think Congress blew it.

I bet inmates in the Pinellas sheriff's jail do not call for the nurse unless absolutely necessary, and then they probably would rather get well on their own.

This is a very good summary of where we are legally at 7:15 p.m. EST. Congress should have been more specific in writing the timetable.

No he doesn't. His reasoning is circular - he assumes that which he is supposed to prove through trial. He assumes that he can rest the case on the case heard in the state trial court - which he is expressly directed not to do in the legislation.

If this judge does not want to follow the law laid out by the Congress, then he should have declined to hear the case and passed it on to someone else.

I have disagreed with you previously on the Schiavo matter, but I'm with you on this one.

The judge denied the injunctive relief on the basis that the Schindlers do not have a likelihood of prevailing at the end.

Nevertheless, even if the Schindlers have a slim chance of winning their case, they will have a moot case if Terri dies.

I don't quite understand the judge's logic, so I predict that the federal circuit court will grant relief.

The judge didn't try the case. He merely held a hearing on granting injunctive relief. And he can only use what is laid before him WHEN CONSIDERING INJUNCTIVE RELIEF. The relief comes first; the trial comes second. Again, I think Congress blew it.

If the case were sent to trial in Tampa, there would be a jury. Wouldn't that save Terri?

The vast majority of potential jurors want her dead.

Oh, now I'm dishonest. Any more names you'd like to call me? Anything? Name calling is all you have in this matter because the fact is the scripture says you MAY divorce for marital unfaithfulness, NOT that you are automatically divorced if one of the people IS unfaithful.

You won't admit that simple and obvious distinction, yet you question my intellectual honesty? That's rich.
