The Terri Schindler Schiavo Daily Threads are created month to month as we watch local and national news regarding Terri and her family.

Since Terri's supporters are in every time zone, you may see something FIRST. Please share news with us that you don't see here already. Now, why would you want to do that? Terri's Daily Thread for September/October of 2004 was viewed over 15,000 times. Terri's November Daily Thread was viewed over 6,000 times. December's thread is over 3,000 views. January 2005 Daily Thread was a RECORD HIGH!!!!!!! 15, 103 VIEWS!!!!!!

More and more good folks are finding out about Terri and that judicial tyranny would take her life, but for lots and lots of prayer and non-stop lobbying of relatives, friends, clergy, our leaders, the media, a passerby, a cashier - ANYONE who you feel comfortable chatting with.

Folks always want to know how can this be in America or on earth for that matter? Unfortunately, this is really happening to an innocent woman who just celebrated her 41st birthday. She's not the only one but she's the one with devoted parents and siblings who knows what's in Terri's heart. Terri has a strong will to live. That's apparent. It's been 14 years.

Besides, feeding tubes have been around practically since the Civil War. They are not high tech devices. Terri is "not hooked up to machines". Her feeding tube is the diameter of a piece of spaghetti.

Talkin' about Terri is the best way to lobby for her. It is a salespitch to save her life and subsequently, many lives. If you've never sold anything in your life, START NOW. START WITH TERRI.

AGAIN WE HAVE A NEW RECORD: 15,103 views on the tote board for the Terri Schindler Schiavo January Daily Thread!

The most significant event in Terri's case in January, was the Supreme's Courts refusal to hear Governor Jeb Bush's appeal, after the Florida State Legislature struck down Terri's Law. This once again places Terri's life in extreme jeopardy, though there are other issues regarding her case before the court.

We disagree. If Michael caused the original physical injuries to Terri, he should be held accountable for them. There is some evidence that suggests he may have, which has made her original collapse all the more suspicious. An investigation (and there should be an investigation which would hopefully remove these suspicions from the realm of speculation one way or another)of the matter might well lead to more conclusive evidence, which is the purpose of an investigation.

However, at the moment it looks as though Michael will get away with all his attempts to kill Terri, and soon may finally succeed if someone in authority doesn't stop him.

Michael has certainly tried to kill Terri for illegimate reasons on multiple occasions. Would it make any difference whether he was prosecuted for four counts of attempted murder instead of three? Adding in the various cruelty charges, fraud charges, etc. along the way, it would seem he'd should have to be Methuselah to see the light of day as a free man, regardless of whether he's charged for an initial attempted murder the night of Terri's collapse.

Indeed, the first murder attempt would probably be the one meriting the lightest sentence, since Michael could probably argue that it was done without premeditation, and might even be able to argue that he wasn't really trying to kill Terri, but she'd said something that put him into a rage (per such an argument, had she died then, he might have been found guilty of manslaughter rather than murder; that she lived would make the charge aggravated battery, whose statute of limitations has lapsed, rather than attempted murder). To be sure, if evidence were found that showed that Michael had tried to kill Terri on that night, that may make it somewhat easier to score a conviction on the other attempted murder charges, but even without that Michael had plenty of motive to kill his wife. If a prosecutor really tries to score a conviction, there's going to be plenty of evidence to convict Michael even if the cause of Terri's initial injuries isn't established.

True. But Michael would need Terri dead regardless of whether he tried to kill her on the night of her initial collapse. Why speculate about the collapse as a motive, when there are other motives which are clear as day?

If an investigation uncovers more evidence Michael caused all those broken bones and brain damage, it will cease to be SPECULATION and MICHAEL SHOULD BE CHARGED!!!!!!!

You don't ignore some crimes a person has committed because that person commits MORE crimes, even if it is against the SAME victim.

We are going to continue to disagree. But that's.... okay.

Continuing on my last point, imagine you were a sentencing judge and the following two separate cases came before you:
  1. Joe Smith got into an argument with his wife, strangling her and nearly killing her. Although he was in a daze afterward and failed to summon quick medical attention, she survived. Joe Smith failed a malpractice claim against her doctor and won $750,000 for her care. Although her condition was later judged to be a result of his attack, he had spent the money on rehabilitation for her and claims that, while he was aware the malpractice claim was fraudulent, he knew of no other way to fund the care his wife needed.
  2. Fred Johnson's wife was severely brain damaged because an anaesthesologist decided to take a smoke break while she was under his care. Fred Johnson initially acted like a model husband, working hard to help his wife get better, until he won a $1,100,000 malpractice award: $300,000 for himself, and $750,000 for his wife. As soon as the award paperwork was filed, he discontinued all care for his wife. A few years later, he found a lawyer and a judge who would agree to have his aware-but-incapacitated wife declared to be in a "persistent vegetative state". On three separate occasions, he was able to discontinue food and water, but on the first two occasions he was stopped by legal action, and on the fourth some National Guardsmen took his wife to a hospital where she received fluids, food, and an examination which showed the PVS diagnosis to be a total sham.
How would you regard these people at sentencing? I would think the first would receive a much lighter sentence than the second, even though the former was responsible for the wife's initial incapacitation and the latter was not.

Had Michael been charged on the night of the attack, it is likely that he might have ended up convicted of agravated battery rather than attempted murder. By now, however, the statute of limitations has expired on the battery charge.

If Michael were charged today, even if attempted murder would still be chargeable (I suspect, but am not sure, that the statute of limitations has expired on that too) his defense attourney would be able to argue that he was only being prosecuted on the more serious charge because the state couldn't try him on the lesser one. Not sure a jury would buy it, but they might.

No, but one does generally ignore crimes a person has committed whose statute of limitations has elapsed. If Terri and her records receive proper scrutiny, evidence of the earlier crime may well come to light. But the focus should be on the present--to the extent that one finds out about the past, that's great but it should not distract from what's going on now.

I'm about to call it a night. Tomorrow's a busy day. I have concert tickets for tomorrow night. If I can manage, I'll try to post something after the presser and before the concert.

It is very quiet around here this evening. SOON TO CHANGE. The weather's great, you know sunshine which would really help Terri. Sunshine has Vitamin A in it and going outside keeps lots of viruses and germs away. Just think of the germ full environment Terri lives in and all that recirculated a/c. She never gets fresh air. That would do her brain a world of good.

If George Greer is guilty of gross criminal negligence from the bench, he doesn't have immunity. This isn't just about his decisions. IT IS GROSS CRIMINAL NEGLIGENCE which is against the Judicial Canons. Greer may have wrongly believed that he could get away with well, uh, anything but HE CANNOT.

I am encouraged by the actions of the Governor's office today.

Also, the gentleman I spoke to in Governor Bush's office yesterday, is the only one who took my call seriously.

Let us pray that Governor Bush has the courage to ACT on Terri's behalf and to once again save her life!

IT MUST BE A MORATORIUM ON ALL OF JUDGE GREER'S STARVATION CASES AND OTHER STARVATION CASES THROUGHOUT FLORIDA. NO MORE. Jim King's legacy of death must end. We didn't get to vote on euthanasia and I certainly think it is my business when the state chooses the manner of a woman's death and there is NO EVIDENCE that she would want to be done in. In fact, Terri is a very joyful being. She would never choose death. The men who are killing her do not understand this. Women unless they are depressed do not choose death. Terri's definitely not depressed.

THIS TO ME IS ALSO A WOMEN'S ISSUE. MEN ON WOMEN CRIME.

Thank you always for your wonderful prayers. Tomorrow will be a reunion of sorts with the original folks who came together in October of 2003. There will be a press conference at 1:00 pm est where Terri is isolated in a single room for no apparent reason - imprisoned for 3 years.

The Holy Spirit is always with her though.
