Ohio Supreme Court Dismisses Voter Challenge to Presidential Election

The Ohio Supreme Court on Wednesday dismissed challenges brought by voters seeking to overturn President George W. Bush's victory in the state and the re-election of Chief Justice Thomas Moyer.

The 37 voters asked to drop both cases Tuesday. The high court granted the resquests without comment.

Attorney Cliff Arnebeck represented the voters who wanted the court to examine several Election Day problems such as long lines, shortages of voting machines in predominantly minority neighborhoods and problems with computer equipment.

The 2004 US Presidential election turned on the state of Ohio's 20 electoral college votes, and not until preliminary results were finally made available the morning after the vote did Democratic presidential candidate Sen. John Kerry concede.

Arnbeck said Tuesday that he could not expect to win given the US Congressional certification of the votes last week and the upcoming inaguration next week.

In declining last month a motion to remove himself from the case, Ohio State Supreme Court Chief Justice Thomas Moyer, a Republican called the voters evidence in the case 'woefully inadequate.'

How is a long line a problem? A voter can wait in the line. Federal law prohibits your employer from docking your pay if company time is spent voting.

Hope you have a great time at W2 ball next week. I'm in Los Angeles, and cannot attend, but I am going to celebrate in my own way: take the day off of work, enjoy my healthcare, provided by my employer (yes, libs, I actually have an employer), go visit friends, SPEND some money, hack off a lib, and hopefully celebrate with other freedom-loving friends the re-inauguration of the President. (I was in India for the first one.)

Could you please PING me if any Los Angeles area Republican or Free Republic chapters are having any celebrations? I tried to contact my chapter, and got no response.

I'm wondering, though, do you think that the Reagan Library will be open that day? I'm open to going there in the afternoon for something, just a thought.

Don't give them that much credit. The membersip of DU could pretty much fit into a phone booth. Their number of registrations total is as high as it is because they have banned so many Freepers from posting over there! And people have to keep reregistering.

It's another plot by the evil Republicans to overturn the election, a la 2000, if only we'd listened to Michael Moore back in 2000 he would never have gotten away with it this time, selected not elected, yada yada yada.

I liked the reason Arnbeck gives : no he could win given Congress' certification of the election results. The TRUTH is there was no way they could manufacture enough votes to overturn the valid election. Now they're reduced to yet another sour grapes attempt to pretend President Bush has no mandate. Well, he won both the EC votes AND the popular vote, so they can just can it

The DUmmies have a new "I Believe [Kerry won]" thread, and there's another where they're visualizing counting the votes themselves. On their own.

Of course the sadsack DUmmies have a difficult time getting past visualizing and believing, to actually doing anything substantive. And they have no money, as usual ("I can't feed my cats, but I'll think positively").

They've also spent the last week contratulating each other on having "all the votes counted" in Ohio, despite the fact that they don't believe "all the votes were counted" in Ohio. They're still running obtuse statistical guesses (nothing approaching real analysis), because they can't believe Ohioans would vote for a Rat in some obscure local race, and for GWB upticket. Split tickets don't compute with the true Rat devotee.

Whackos.
