Since other media outlets are doing the same thing to MOVEON.ORG it's probably better to let it go.

Right. Earlier in the year, MOVEON.ORG tried to air an ad with President Bush appearing on Meet The Press, and NBC wasn't too happy about it and told the goons at MOVEON to take the Meet The Press footage out. The whole ad ended up being scrapped because the entire 30 seconds was bits and pieces of soundbytes MOVEON wanted to impugn President Bush with his own words.

§ 107. Limitations on exclusive rights: Fair use
Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include -

(1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
(2) the nature of the copyrighted work;
(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
(4) the effect of the use upon the potential market for or value of the copyrighted work. The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.

I don't think it is necessary to understand the distinction between medals and ribbons. That is not the point. Kerry is shown using Clintonian parsing of words, i.e., It depends on what the meaning of "is" is. Caught in a lie, Kerry said clearly in 1971 that he threw away his medals (not ribbons), but in 2004 he says that medals and ribbons are interchangeable. Like Clinton, Kerry can change the meaning of words to fit his story.

It is a powerful ad, which is why the Dems and ABC want to stop its airing. This is the second ad concerning Kerry throwing away his medals and his attacks against American symbols. I predict that there will be a third ad showing that Kerry really did throw away his medals in 1971 and that he was lying on GMA. Kerry not only requested new medal citations in 1985, but also, new medals.

The SBVFT 30 second ads need to be viewed as a mosaic or part of whole story that needs to be told. Their effectiveness should be judged in their totality rather than as individual ads. Stay tuned.

I've worked in television for about 18 years, mostly in commercial production, and I'm certain the Swifties haven't done anything wrong. Once ABC "broadcast" the video it's pretty much "fair game". We always see campaigns use the opponents owns spots against them, so I see no difference with a news broadcast. I don't think it's an issue of "partisan purposes", but an issue of "use for profit"

If you want to use footage from any of the networks in any form of documentary aren't you required to pay them for it? I thought anything a network broadcast was immediately copyright material. I am fairly certain you have to ask their permission to use it. Furthermore, I do know another network successfully stopped MOVEON.ORG from using their footage.

I half suspect that the slightly choppy editing was intentional, to provoke the Kerry camp into addressing the matter...

I can see the DU crowd running to the transcripts and being disappointed.

I've always been under the impression that the copyright is for purposes of preventing others from profiting from the material. We have always used the "9 second rule", that is, use no more than a 9 second clip of another's running video. And that could be an undocumented rule itself!

One would think that Michael Moore would have tested any & all copyright rules with his "crapumentery"!

I do know if you are making a documentary you can call any of the networks and buy footage from them. I am not sure if they charge for the footage or for it's use, or if they can prohibit certain uses. It's an ineresting question. On the other hand, it's hard to believe a network would tell a campaign they CAN'T use footage if they weren't within their legal rights. They certainly have enough lawyers.

Don't copyrights expire after 20 years or something. I know that songs are used in commercials all the time and after some period of time the copyright on the song expires and they move into the public domain. At that point the song can be used by anyone without paying for it's use.

It doesn't cost alot of money to tell the truth. But it costs a fortune to manufacture lies and try to cover them up.

Moveon and the other Socialists that dupport the DNC are spending millions to manufacture lies and pay off the people that will cover for them. The Swifties are producing simple commercials telling the truth.

I would tend to think this falls under "fair use" too. However I'm more knowledgable of a software/literary copyright and am aware that broadcast and rebroadcast of video and recordings follow some pretty complex rules. So who knows.

No they don't, but they own the images sent out. They are copyrighted. Just like something that appears in a newspaper. However there is the same exemption for quoting copyrighted material that applies right on FR. For purposes of public discussion you can quote excerpts, even if the source objects. You cannot post entire works, if the copyright owner objects.

In this case I'd say that the SwiftVets did the video equivalent of posting excerpts.

As a counter charge all it would take it to find a Soros type 527 ad that uses ABC source material, and ask ABC whey they didn't object to that.
