Welcome to FR. We sure have a lot of new folks around here -- it's great.
It almost reminds me of good old days of the Clinton-Lewinsky scandal -- gosh, those were good times!
I am not a lawyer, but I think that ABC has a copyright on everything it generates, even recordings of newsworthy events and public figures. Maybe a lawyer could chime in on this and whether footage being from a pooled newsfeed would make a difference.
I have no idea of whether this would fall into the "fair use" category, but it might, since the clips are short. I suspect that by the time ABC could do anything about it, the ad will have run its course.
The Swifties are certainly doing quite well at generating controversy and getting a lot of free publicity.

I agree with both statements, but unfortunately, perception is reality with most viewers - and you KNOW - the MSM will take the opportunity to spread the fiction that his words were taken out of context.
Specifically, the very last line by Kerry - "and I'm proud of that.." or something to that effect, looks like it could have been chopped from anywhere during that interview, which means it could have been in reference to something unrelated to his medal chucking. The careful viewer, though, can see the movement of his arm coming down to make the coming point at the very end of his second-to-last video cut. And in the last cut - his arm continues down to make the point that he's proud of chucking his medals.
However...how many viewers are going to notice that? And how many MSM outlets will helpfully point that out?
Maybe they will sue? :o)

They'll probably tell ABC the same thing they said to those who thought they should be sued for putting out the book because it was a pack of "lies".....

Brothers, I got all the confidence in the world in John O'Neil and his crew.
So ABC, sue the SBVfT, it will guarantee full media coverage with snips of the ad. It will generate more exposure than the SBVfT could afford to pay for similiar tube time.
Has the DNC taken down their ad featuring news clips from both CBS and NBC? I remember they have both asked DNC to pull the ad, but last I heard, DNC said they will think about doing it.
I am sort of hoping that ABC turns this into a big deal. If they do that, more people will see the ad. I wonder if ABC is that dumb?
I heard Ginsberg speak on this in an interview. He does review the ad content for the swifties. That's part of what he does. The kerry clip would have to have been cleared by Ginsberg before the commercial was made. It may have something to do with the uplink company that did the uplink service for abc during kerry's remote appearance on Good Morning America. Swifties will likely run this ad and wait to see if an injunction is ordered.

Come on all, we need to kick it up to 100,000 individual contributions. The 100,000 small donations to the SBVfT alone is a big time news item they can tout to the MSM. And then dare the lefty 527 to release how many individual contributions and what is the average.
Between Soros's untold millions and the thirteen million dollars Jane Fonda has given to them. Their individual donations will likely come from less than a few hundred people at 10,000 bucks or more each. You know, a real grass roots thingy from the little people.
My point was that it does not matter.
ABC, CBS, and NBC have made an art-form out of ignoring the SBVets story. This will force them to report it and possibly even to show the commercial to shoe their case. Controversy, in this case, is good. So, either their is controversy publicizing the Swift Boat cause or the networks let them use the film. Either way, the SBVets win.
After the election, if the networks sue, the case will linger in the courts for years costing the networks a ton of money, but the beneficial effect on the Swift Boat Vets will be immediate.
It is a good strategy. It puts the networks between a rock and a hard place.
Bush may regret allowing Charles Gibson be a moderator.
