Mom Sent To Jail For Smoking Around Kids

BOWLING GREEN, Va. -- A woman was sentenced Thursday to 10 days in jail for defying a court order not to smoke around her children.

Tamara Silvius was banned last year from smoking around the youths, now ages 8 and 10, as part of a custody arrangement with her ex-husband.

How right you are.

I don't know much about the NY Restaurant Associations, except that at least one of them has folded on this issue and will not continue to fight it.

The Restaurant Association in Delaware fought that ban tooth and nail - until the legislature amended the ban to include bars and the race tracks.........then they supported it totally. Of course the majority of the small minority of restaurants in DE that belong to the Association are the major chains probably haad nothing to do with that, now did it?

Divorce situations, particularly involving children and the ensuing custody battles, are always ugly. The articles here don't give enough information as to why this particular issue was in the custody agreement to begin with.

If the children have a health condition that is exacerbated by certain pollutants, then fine. If it's just because the father is a jerk, then I question the competency of the mother's attorney (if she had one at all) in allowing her to agree to what seems to be an extremely vague prohibition of smoking around the children.

There are always 3 sides to every divore: his, hers, and the truth. And that gets further complicated if there are chidlren in the mixture. I know all of this because I divorced a man who who had children from a previous ex-wife.

As to the support of this nonsense by supposed conservative - I'm at a loss.

Howdy Chad - long time no see!!!!!

It's amazing that these loony anti-smokers truly believe inhaling all that car exhaust is just fine and not detrimental to health, but being near someone smoking a cigarette is deadly.

Some people just have no sense of proportion or priority.

I don't mind a debate over disagreements on stuff - but the bashing of smokers so many of them immediately start has gotten extremely tiring.

Hubby and I were discussing this story the other day and he was absolutely appalled and commented that smoking should be the very last thing any judge, or even parent, should be concerned with when it comes to a custody battle.

What is wrong with people?????

How does your endorsement of infringement upon the rights of a business owner make you a conservative?

Smoking bans infringe upon the rights of people willing to invest their money and time and lives into a business. Including those who have already chosen to be smoke-free.

It was the fact that a judge would order sometyhing like that which is unfair. Suppose we substitute the internet, and FR for cigarettes in the judges order. I wonder how many on this forum think they could comply. Let's begin with you.

Someone in here once said: I will sit in my closed garage with a friend, and we will both smoke continuously for an hour.

You can sit in your enclosed garage with your car running. I will place a bet on who comes out alive.

Well that's why people shouldn't get divorced to begin with, T.S. See, that's what happens when people allow the government inside their families.

But I still say the mother is a jerk for smoking around her kids. Everyone knows it's not good and even if some dork out there still has a doubt, why not err on the side of caution? The doctors tell you to stop smoking when you are pregnant and I think all moms should make sure they keep it that way from then on!

So you endorse the rights of business to not serve whites? Jews? Blacks? Their choice?

Local governments have a right to set standards for what can and cannot be done in busineses LICENSED to operate in their jurisdiction. The building must be up to building code. The parking lot must be adequate and up to code. This is a no-brainer that prohibiting smoking is well within the tolerances already acceptable.

We are not anarchy no matter how much you want it.

No one is a born smoker. The person chooses to engage in such behavior that IS, in fact, harmful to those around them. Laws which protect the general populace from the selfish desires of a few are perfectly acceptable.

I would like to see the same conservative common sense that I promote for this apply to abortion -- that is infringe upon business to not be legally allowed to provide abortion services.

Bottom line. I am WITH NO DOUBT, one of the most conservative people here. This issue is one that crosses ideological lines. Your ignorance causes you to look at ONE issue and declare that because you don't agree with me, that I cannot possibly be a conservative.

Wow! I'm sure thankful I had my kid back when all this anti's chit wasn't flying around.

I smoked all during my pregnancy. My kid weighed in at 8lbs 12 ounces, and 21.5 inches long. Sure didn't stunt HER growth.

She registered 10 on the APGAR scale right after delivery.

It is not harmful to those around them. Smoking can be harmful to the smoker, period. You bought into the BOGUS second hand smoke studies, because you have always hated smoking, and are an avowed antismoking nazi, admit it.
