Mom Sent To Jail For Smoking Around Kids

BOWLING GREEN, Va. -- A woman was sentenced Thursday to 10 days in jail for defying a court order not to smoke around her children.

Tamara Silvius was banned last year from smoking around the youths, now ages 8 and 10, as part of a custody arrangement with her ex-husband.

I don't think it is a clear public health matter. Smoking habitually is clearly dangerous to the smoker, but I don't think you can say that about occasionally dining near a smoker.

What Eve did was "illegal." Smoking is still legal last time I bought tobacco.

You are correct. There is no law requiring me to eat out in a public place.

In fact, back when getting smoking out of restaurants seems far-fetched, I was for restrictions on smoking areas, but still allowing smoking. Common sense things like bathrooms and waiting areas had to be located in the non-smoking section. Smoking sections must be separate rooms or separated by a non-smoking buffer for those people who don't smoke but don't mind.

However, we got an even better resolution with the complete non-smoking ban.

The bottom line to all this is that this is NOT a liberal issue. As I've said, I'm very conservative and this is a non-contradictory conservative position. It is, with no doubt or question, equal to wanting to prevent abortion because it endangers the child. That too is a conservative view. Liberals want to say "if you don't like abortion don't have one" which is, in fact, the argument you are presenting.

You can smoke in your house, fine. Preventing you from smoking in a restaurant is not a tyrannical issue at all, but a health issue for those who don't wish to smoke.

It a big government issue where choice is taken away from private establishments.

If restaurants want to make the choice for non smoking, that's their right. If they want to make is smoking, that should be their right without the public health statists funded by George Soros and the Tides Foundation and running to government.

Reminds me of Atlas Shrugged.

Doesn't matter. She signed onto the custody agreement and agreed to be bound by it. Violating a court order constitutes contempt of court.

I wonder who "snitched" on her. Were her kids turned into little snitches???

And if you read post correctly she was NOT told she couldn't smoke, only that she could not smoke in front of children....

As for God's opinion of smoking, look again....we are not supposed to defile God's temple--our bodies, and yes we have freewill but will reap consequences of same.

Straw man.

Abortion is direct taking of one life by another. Smoking doesn't since there's a choice of avoiding the area.

Anyone can avoid smoke in a restaurant by not patronizing it. If you want a smoke free restaurant, start your own or patronize one that is. That's the RIGHT way of doing things.

But they are wrong. A gun must be used by someone to inflict harm. Normally there is intent.

Cigarette smoke is harmful passively because it pollutes the air that others breathe, infringing upon their rights. Pure and simple.

If we outlawed smoking, you might have a case. But protecting the rights of citizens from those few who use tobacco is common sense.

This post is not about criminalizing smoking, it is about disobeying a court order. A court order that is very simple and not violating any of her constitutional rights. She was told not to smoke AROUND THE CHILDREN, she could have smoked outside, in a different room, in her room...but she defied the order, and just who do you think told on her. Maybe the children did not want her smoking around them...ever think about that? Who turned her in??? Good question huh.

Not a strawman, but an identical parallel. Nice try, however.

Restaurants are considered a public place, therefore the public health considerations and the rights of the patrons must be paramount.

If you prefer, and seem to be saying, we should have "WHITES ONLY" restaurants, since blacks can start their own restaurants if they want to.

Sorry, that liberal crap doesn't wash here.
