DNA can come from skin, and from pre-seminal discharge.
That is entirely different from motile sperm, which is living sperm.
This is rumor mill stuff, but FWIIW -- Kobes team is subpeoning text messages from the complaining witness that basically brag about her encounter. If even a tiny % is true, then Kobe is in the clear and he may have recourse.
But I don't want that to happens quickly since every single time Kobe comes back from Colorado he kicks butt and the Lakers win!

Bellman in Bryant case asked for DNA sample

The bellman - known legally as the "outcry witness in the Kobe Bryant rape case - has said he will voluntarily cooperate with a defense request for a DNA sample.
That bellman, Bob Pietrack, says he has nothing to hide.

EAGLE, Colo. — Kobe Bryant's attorneys plan to argue at Thursday's hearing in Eagle County Court that telephone records and text messages from the woman accusing the Laker star of rape in the days surrounding the June 30 incident should be released.
The defense also wants records of calls and messages sent and received by other key figures in the case, including the woman's longtime boyfriend and the bellhop at the Edwards, Colo., hotel where the alleged rape occurred.
All one has to ask, Did the injuries occur with Bryant, or the second man? Reasonable doubt. If she lied to the police, any testimony she makes, is under a cloud.
This is what I have thought all along. How do they know the marks were made by Kobe? I don't see how you could tell.
In a request filed under seal, Bryant's defense attorneys asked Pietrack and at least one other male to submit DNA samples for analysis, sources said. But prosecutors have protested the defense request, sources said.
I guess he decided he'd "volunteer" after their filing. Too bad he didn't do that last July.
