Believers in the U.S. Constitution and the Declaration of Independence:
Where is Terri's independence?
I'm talking about her independence to learn and to be free from her lonely room.
To kick off Terri's May-June 2004 Dailies, our first article is by Deroy Murdock of Scripps Howard News Service.
Let Terri Schiavo's Parents Restore Her Dignity. May 22, 2004

The videotape story is really interesting. Some of Felos' law firm's employees took the witness stand. THEY SENT FOR THE VIDEO OF TERRI BY MAIL, you know to entrap Terri's dad. He wasn't even the source of that video to begin with.
WITNESSES: HOSPICE STAFF, FELOS EMPLOYEES - 2 AND BOBBY AND POPS SCHINDLER. That's why it will take time to transcribe my notes. There were so many witnesses just so the Schindlers could get visitation on Saturdays between 1:00 and 2:30 pm on Saturdays. I guess an elder relative of Terri's was in attendance That lady was in tears because she can't see Terri, only mom, dad, Bobby and Suzanne. MS's attorneys are pale, nit picky, inflammatory, paranoid, zombie-like culture of death enthusiasts. And, I'm including Scott Swope in that description. The police said no wrong doing. Swope was trying to intimate that the Schindlers still "may be guilty". HORSE PUCKY.
CNN AARON BROWN TONIGHT AT 10:00 PM
The parents of Terri Schiavo will be featured on News Night with Aaron Brown tonight (Wednesday - May 26, 2004) at 10.00pm ET (GMT-5). The segment will also feature a recap of today's hearing regarding visitation.
Mr Brown's web site is on: http://www.cnn.com/CNN/Programs/aaron.brown/
An hour and a half once a week. How generous of him.
Thank you so much for this detailed report. I have been waiting all day to hear how things went. I prayed most of the morning for Terri and this hearing. The " confusion" of the witnesses may be a good thing in the long run!!!!
I wish the Schindlers could get a hidden camera in that room. These judges are up to no good.
What would it have hurt to give these parents more visitation? Lord only knows whats happening to Terri when her parents aren't there.
Here is the report from Mitch Stacy with Associated Press. I want to make it very clear that Mr. Stacy kept his report very clean and neutral, IMO, even though the whole fiasco in court was beyond confusing. Please note that he did not state the Schindlers have visitation reinstated as some local media are reporting. He has correctly reported that this issue is still for grabs.

Judge to decide on parental visitation limits in Schiavo case
MITCH STACY
Associated Press
CLEARWATER, Fla. - The parents of a severely brain-damaged woman will be allowed an unsupervised visit with their daughter this weekend, but a judge will decide whether future visits should be monitored.
Terri Schiavo's husband wants to put restrictions on the visits, and his attorneys told a judge Wednesday they should not be allowed in her room at the nursing home without supervision.
The parents, Bob and Mary Schindler, say their son-in-law, Michael Schiavo, is harassing them because of their efforts to keep her alive against his wishes. Michael Schiavo has sought for years to remove his wife's feeding tube so she can die.
But Michael Schiavo's attorneys point to a March 29 incident where they claim puncture marks were found on Terri's arms after a visit by her parents. Clearwater police reported no evidence of a crime, saying the marks probably were caused by the apparatus used to lift her in and out of bed.
But the husband's attorneys say the incident was suspicious enough to warrant restrictions on visitation. They also told Circuit Judge George Greer that Bob Schindler violated a court order by shooting a videotape of Terri last year, and supervision is necessary to make sure it doesn't happen again.
The Schindlers said they had a supervised visit Sunday, the first time they were allowed to see their daughter since March 29.
Greer said the Schindlers and Terri's brother and sister could have a 1 1/2-hour unsupervised visit Saturday, and he will rule sometime next week on the husband's request for future restrictions.
"The fact that we get back to see her makes us happy," Bob Schindler said after the hearing.
The Schindlers have been battling Michael Schiavo in court for years over the fate of their daughter, who court-appointed doctors say was left in a persistent vegetative state after collapsing from a chemical imbalance in 1990.
Her husband has fought to remove her feeding tube, arguing that she would not want to be kept alive artificially. Her parents doubt she had any such end-of-life wishes and believe her condition could improve with treatment.
The case garnered national headlines in October when the Florida Legislature and Gov. Jeb Bush stepped in to save Terri Schiavo's life after a court had ordered the tube removed.
Michael Schiavo sued Bush, contending that the hastily passed law giving Bush authority to reinsert the tube was unconstitutional. A circuit judge agreed, and that decision is under appeal.
The 2nd District Court of Appeal has indicated that it wants the case expedited to the Florida Supreme Court.
Thanks for the notes from todays hearing (post 156).
It certainly is a tragedy the Schindlers will still be
locked out 166.5 hours per week, and other friends and
relatives, and Terri's priest will still be locked out completely.
I seem to recall a nurse posted a federal nursing home law
that forbids relatives from being locked out of visitations
to the disabled.
Maybe that law could be used to take this case federal.
Someone please summarize the CNN story tonight. I don't
pay for that guttertrash channel.
And maybe Diogenesis or someone else would be so kind as
to make a few screen snaps of the CNN story tonight, if
they show any courtroom photos.
And everyone else, also note post 166 and the AP article...
The " confusion" of the witnesses may be a good thing in the long run!!!!
Sorry, the "confusion" of the witnesses means nothing to these liberal FL "judges" who apparently are either "Republicans" or at least wear the Republican "label." These judges will never cease until this poor woman is dehydrated and starved for good! There is no hope with these "judges."
I don't know how the rest of you feel, but I believe this THE MOST PATHETIC, INSULTING, CRUEL, UNUSUAL, UNCIVIL, UNJUST and SICKENING RULING regarding visitation of Terri's parents imaginable.
ONE AND ONE HALF HOURS PER WEEK?????
I would think Floridians would be UP IN ARMS!!!!!
GOSH I WISH I LIVED NEAR.
I hear Bob Schindler-beaten down and grateful for any CRUMB thrown his way and needing to appear gracious, for obvious reasons-saying he is pleased to be able to resume regular visitation.....BUT WHAT THE HECK....
WHAT IS ONE AND ONE HALF HOUR PER WEEK? GET REAL.
This is justice meeted out with overtones of sheer cruelty.
And HOW CAN A VIDEOTAPE OF ONES OWN DTR BE SOMETHING A JUDGE HAS TO CONSIDER???? PONDER???? Oh horsehockey.
This videotape has been around forever....and it represents the DESPARATION of parents attempting to give the world proof that their dtr can function, shows joy, WANTS TO LIVE; that their dtr has fought VALIENTLY and under CRUEL CONDITIONS of virtual TORTURE (no stimulation, no joy, no joining in community events in her prison, NO OUTDOOR OUTINGS, no BLEEPING ANYTHING) ....HORRENDOUS HORRENDOUS....with a husband who probably whispers into ear how he wishes she would die going on constantly.....SURELY TERRI HAS PROVEN SHE HAS A MIGHTY WILL TO LIVE despite this HORRIFIC ASSAULT!!
What is WRONG with this picture????
EVERYTHING!
How I wish this horror of a judge would stop playing a game of delay, and obfuscate, and delay and ignore, and delay and piece meal out his nasty and hurtful rulings.
How I wish a POWERFUL media person would expose what this man in collusion with felos and MS has done to this woman and her family!
Terri IS an extraordinary fighter. And and she is covered by the prayers of many....MANY!!!
As long as MS and Felos keep her in a hospice, where the underlings are trained in helping those who are DYING to pass peacefully...TERRI IS AT RISK!
MS and Felos and GREER have her in a death house when she ISN'T DYING.....she is in a DEATH HOUSE BECAUSE THEY WANT HER TO DIE. And she is tended to by those who probably believe that she IS DYING thanks to their handiwork (MS, etc.)
We must keep her surrounded by prayers and we MUST write to those in authority and DEMAND this HORRIFIC GAME END.
CAN ANYONE, ANYONE, DOUBT THAT TERRI HAS DEMONSTRATED, DAY AFTER ENDLESS BORING DAY, WHILE SURROUNDED BY MONSTERS WHO HAVE KEPT HER LOCKED UP AND AWAY FROM THOSE WHO LOVE HER, A TREMENDOUS WILL TO LIVE?????
Let's pray and move this mountain of cruelty. Let's pray for FULL EXPOSURE of the entire cabal of attorneys, judges and MS and his sickening concubine and her depraved family, a family WILLING to monitor the Schindler's when they are in their own dtr's room. DISPICABLE. HORRID. SICK. and DIRTY!
Rant OFF!!!!
Thanks for the ping. I read part of the thread, but will have to catch up on the rest later. I'm relieved they get to see her again, but still holding my breath to see what happens next. Prayers for Terri.

Free Republic beats the AP to the punch. Admittedly, that was just my summary draft. Wait until I type my Final Court Summary...It was quite a hearing and all the joyful, loving people appear to be on Terri's side of the courtroom.
The others have no souls. They are the palest folks I've ever seen. Maybe they don't value fresh air and spend their spare time "in the dark". Seriously, all of HINO's attorneys look "translucent". It's bizarre. They are soul-less wonders in business suits.

Not sure if this was posted or not. An article on National Review about Terri entitled, LET TERRI LIVE
http://www.nationalreview.com/murdock/murdock200405261342.asp
Imagine I sat on the bench next to one of the Hospice witnesses before the hearing and said to her "you know, they aren't kind to woman in this County." She said "How so?" I stated "They're trying to kill Terri Schindler-Schiavo." She jumped off the bench in the lobby. This may be a repeat but on 2nd thought, it may have been Janice Boutin. I have pictures of Hospice's sorry behinds in the dark hallway and it's not worth uploading. lol
Greer stated he would have a definitive decision a week from this Friday... He never makes up his mind the day of any hearing. And, the way he questioned Terri's dad was a garbled gunk from the bench. They need to protect Terri from the people who are trying to save her life. THIS IS THE TWILIGHT ZONE, the Sixth Circus, and it was a circus...
What really bothered me was that one of the Hospice staffers said that they ALWAYS checked with Michael first, EVEN BEFORE CONTACTING A PHYSICIAN IF TERRI WAS HAVING AN EMERGENCY!!! That's on the record. They've all been told to talk to Michael first. I guess Michael can deem if it's an emergency or a no code from his barcalounger???
I don't think Monsignor Malvaneux can see Terri and other family beyond immediate. People were crying in the courtroom because they were formerly on the visitor list.
Thank you SO MUCH for all that you do! You are our eyes and ears, you are a general in Terri's army, and your work is for such a worth cause, standing for the VALUE and IMPORTANCE of Terri's very life, her existence, and her family's desparate work (something they should have NEVER HAD TO UNDERGO, EVER!)to do the same, gosh, thank you so very much, Floriduh_Voter.
I still too furious to post rationally-what has happened to Terri just chills me in surprising sharpness. But I look forward to every post to lay out for us.
Nursing Home Reform Act
The nursing home facilities that receive federal funds are required to comply with the Nursing Home Reform Act. This includes:
-Employ sufficient nursing and other staff in order to provide nursing and related services.
-Be administered in a way that enables the nursing home to use resources effectively and efficiently.
-Within 14 days of admission, perform an initial comprehensive, accurate, standardized, reproducible assessment of each residents functional capacity. After significant changes in the residents physical or mental status and/or at least once every 12 months, perform such an assessment.
-Develop comprehensive individualized care plans for residents. Care plans must include measurable objectives and schedules to meet each residents medical, nursing, mental and psychosocial needs as identified in the comprehensive assessment discussed above. The care plan must be developed within 7 days after completion of the comprehensive assessment. It must detail the services that are to be provided. The care plan must also be periodically reviewed and revised by a team of qualified persons after each assessment.
-Provide pharmaceutical services (including procedures that assure the accurate acquiring, receiving, dispensing, and administering of all drugs) to meet the needs of each resident.
-Provide supervised medical care by a physician. The nursing home must provide or arrange for the services of a physician on a 24-hour per day basis in case of an emergency.
-Prevent the deterioration of a residents ability to bathe, dress, groom, transfer and ambulate, toilet, eat, speak or otherwise communicate.
-Provide necessary services and assistance in order to maintain good nutrition, grooming, and personal and oral hygiene if the resident suffers from any impairment daily living activities.
-Ensure that residents do not develop pressure sores. If a resident has pressure sores, the nursing home must provide the necessary treatment to promote healing and prevent infection and development of new sores.
-Provide treatment and services to incontinent residents to restore as much normal bladder functioning as possible and to prevent urinary tract infections.
-Ensure that residents receive proper treatment and any devices to maintain hearing and visual abilities.
-Ensure that residents receive adequate supervision and assistive devices to prevent falls.
-Ensure that residents maintain acceptable parameters of nutritional status, such as body weight and protein levels.
-Provide residents with enough fluid to maintain hydration and health.
-Prevent medication errors.
-Care for residents in a way that promotes maintenance or enhancement of their quality of life.
-Promote resident care in a way and in an environment that enhances each residents dignity and respect in full recognition of individuality.
-Ensure that residents can choose activities, schedules, and health care consistent with individual interests, assessments, and plans of care.
-Maintain clinical records on each resident in accordance with accepted professional standards and practices that are complete, accurate, accessible, and systematically organized.

AND THIS from another site
Q: When can a nursing home resident receive visitors?
A: Under federal law, a resident's family member generally must be allowed to visit the resident at any time, assuming that the resident wishes to be visited by that family member at that time. Similarly, a resident's friend generally must be allowed to visit the resident if the resident wishes to receive such a visit, although a nursing home can place "reasonable restrictions" on social visits from persons who are not family members.
A resident's doctor or a representative from the ombudsman program generally must be allowed to visit the resident at any time. A person who provides health, social or legal services to the resident must be given "reasonable access" to the resident, assuming that the resident wishes to see that person.
The federal law discussed above is part of the federal Nursing Home Reform Act, which applies to every nursing home which accepts money from the Medicare Program and/or the Medicaid Program, even if payment for the particular resident involved does not come from either Medicare or Medicaid.
