CA: Gay marriages stand as Calif. judge delays ruling

SAN FRANCISCO (AP) - A judge delayed until at least Friday a ruling on whether to block San Francisco from issuing same-sex marriage licenses.

The ruling occurred during the first of two such hearings Tuesday. Another judge was scheduled to hear a similar case in the afternoon.

I fear the end of our Republic is near. There is no more separation of powers.

We have judicial activists legislating from the bench. (Roe v. Wade, Lawrence, etal)

We have members of the executive branch interpreting law. (Mayor Newsome declaring Prop 22 unconstitutional).

An interesting reply from a gay friend in SF

"It's not as good as you might have thought.

First, it costs $82 to get a license. Then, the
county sends the forms to California state officials
in Sacramento. And California state officials have
already said they won't record them. They will return
them to the County as defective. Counties have no
authority to modify the state forms for marriage. And
the city did print new forms that are not in
conformity with state law. The state form asks for
"Groom" and "bride" and has other sex-specific
entries. The city form changes all these, so the
forms are null and void, in the state's view.

I'm afraid it's just a big circus, with no lasting
legal effect. We would do it if the state would
accept the forms. Also, however, it's been raining
and people signing up must wait in huge long lines
around City Hall. Also California is a community
property state, so there would be certain financial
ramifications if we got married. We don't
mingle our money, so we would probably need a
pre-nuptial agreement. Lots of work!"

The point about the state's position on the licenses issued have been confirmed by news reports.

I should also add that this friend is Republican leaning.

Wendy Daw, 36, and Belinda Ryan, 39, said they hoped their official marriage license would help them obtain a green card for Ryan, who is in the U.S. from Wales on a temporary work visa.

"To get an application to sponsor someone for a green card, you need to bring a marriage license," said Daw. "On Tuesday, I'm going to go to the INS--we'll probably get turned down, but I'm going to ask."

This issue will continue to escalate.

I wonder if any of them actually acknowledged being virgens,?? and actually consumated their vows after the ceremony.!! That would be a good feat. Happy marriages statistically are those who WAIT...to Wed before going to Bed....uhmnnnn

In the early hearing, San Francisco County Superior Court Judge Ronald Quidachay said he was not prepared to rule on a lawsuit filed by conservatives to block the marriages - more than 2,300 of which have taken place since last Thursday.

A possible candidate for a Supreme Court appointment from President Kerry???

The judge is a 1983 Jerry Brown appointee. Hardly any surprise for him to stall and delay in the name of leftist political correctness.
