U.S. military and Justice Department officials tell NBC News that a U.S. Army National Guardsman was taken into custody Thursday at Fort Lewis, Wash., and charged with attempting to pass intelligence information to the al-Qaida terrorist network.

The officials said that Anderson was caught up in a sting operation conducted jointly by the Army, the Justice Department and the FBI. Anderson, however, is currently being held and charged only by the Army. Anderson is a Muslim, officials said.

Not the case: Capt. James Yee, 35, a former Fort Lewis chaplain, is accused of mishandling classified information from the U.S. prison for suspected terrorists at Guantanamo Bay. Yee ministered to Muslim prisoners there. A preliminary hearing for Yee at Fort Benning, Ga., has been postponed a fourth time, until Feb. 18, the Army said earlier this month. The Army said the delay was necessary to complete a classification review of documents. There were initial reports that Yee was being investigated as part of an espionage probe, but he was never charged with spying.

WASHINGTON - A Muslim chaplain who was suspected of espionage at the U.S. prison camp at Guantánamo Bay was released Tuesday (11-25-03).

Army Capt. James Yousef Yee, 35, spent 76 days in confinement, some of that in maximum security, but in the end, the charges against him were far less serious -- including adultery, conduct unbecoming an officer, failure to obey an order and making a false official statement. The new charges include making a false statement, storing pornography on a government computer and having sexual relations outside marriage, which violates military law.

The adultery allegedly occurred with an unspecified woman at Guantánamo and in Orlando, Fla., between July and September 2003, and the pornography was on his government-issued computer at the base in eastern Cuba, according to Raul Duany, a press officer for the U.S. Southern Command.

Yee, who is married and has two children, was released from the Navy brig at Charleston, S.C., one day after his attorney wrote President Bush that the chaplain's confinement was not warranted by the charges.

Maj. Gen. Geoffrey Miller, commander of the prison facility at Guantánamo, decided that Yee ``presented no flight risk'' and ordered him to report to Fort Benning, Ga., said Southern Command press officer Christopher Sherwood.

Yee will be ``assigned to the chief chaplain there to perform whatever the chief chaplain wants him to do,'' said Tom Crosson, another press officer at Southern Command.

Not just yet, my FRiend. We first give him a fair trial- in his case, perhaps a court-nartial- and determine the damage previous actions on his part may have done, and the possibility that information from him may lead to others involved. Death may indeed be the prescribed penalty- or it may not, depending on his cooperation.

In the field, under more immediate circumstances, yes, an immediate execution may take place; such things have happened. But not in this case, I think. Better to let the law stand, and see how Justice takes its course.

If he will not serve his country as he swore to, and is convicted, perhaps he can better serve as an example.

My father-in-law was in Korea from 1948 to 1950 and saw instant military justice. One spy was tried on one day and shot the next. He has 8mm movies of the firing squad. A few more like that and this crap would come to quick end.

That is the kind of justice we need NOW for these ANTI-AMERICAN pukes.I would love to see it.

A little clarification - my father-in-law was an advisor to the Korean Army from 1948 to 1950. They actually still have horse cavalry then, he has many pictures of him in riding atire. The spy was communist with the mission of killing my father-in-law. Without the firing squad, no Mrs SLB! My hat is off to them.
