My issue here is that they are going after Rush for making LEGAL withdrawals from his bank account to buy the pain medicine..if they cannot prove that he was doing something wrong to begin with the medical records have no basis in law to be taken

It seems that his own doctors would have given him the prescriptions if he needed them. the way it works is that a Dr issues a legitimate prescription for the drug, the patient uses them and often (in cases where the pain is chronic and the usage open ended)gets hooked on them. Sooner or later the Dr or the pharmacy gets antsy about issuing or filling the scripts and the patient changes Dr's and pharmacies...eventually they buy them on the street.
I have a brother in law who's been through this and I usually have zero sympathy for druggies...but he got hooked on oxycontin by legitimate use. It's not like he drove to the ghetto to buy crack and eventually got hooked.

With four doctors in the picture he may have been getting all the prescriptions he needed.
That is we now know about four doctors. There may be others.

Either way they are expending an UNUSUAL amount of effort on this one case. IN NO OTHER CASE would the Palm Beach State Attorney's office be expending this much time (courts are facing budget cuts) and effort ($$$) on a single user case.
In the normal course of business, they would have dumped this case in drug court in March of 2003 and forgotten about it. They had no evidence then, now they must have DNC pressure attacking them.

Was he? Now it's been said he may have bought some on the blackmarket but not a fact in evidence as of yet... IMO he most likely did but not proven as of yet.

I haven't been following this that closely but seems one issue was he said he required extremely large doses. Doctors probably would not have given him as much as he wanted. Plus I believe he said in some many words that he enjoyed taking them (not a very bright confession to make to millions of listeners IMO).

American doctors are good; they give you painkillers and tranquilizers even when you don't really need them. You'd have more luck getting blood from a stone than you would in getting Valium off an NHS doctor in the UK. (I oughta know.)

Unless you can supply a source that has definitive proof, you should refrain from making such comments.

The fact that they're going after his doctor's records would seem to indicate that they didn't turn up anything with the blackmarket stuff.

It seems that his own doctors would have given him the prescriptions if he needed them. Doctors don't always provide patients with the meds needed to stop their suffering.
Ask relatives of people who've had family members dying of cancer how difficult it can be sometimes to get the Doctors to give them the meds they need to even sleep at night.
