Governor Seeks New Trial Over Brain Damaged Woman's Wishes

Gov. Jeb Bush fired a volley of legal shots Wednesday at the husband of a brain damaged woman who is at the center of a right to die case, saying there needs to be a jury trial on whether Terri Schiavo wanted to be kept alive artificially. The governor also sought to remove Pinellas Circuit Court Judge W. Douglas Baird from hearing the constitutionality of the new law enacted to keep Terri Schiavo alive after her feeding tube was removed last month. In yet a third legal filing, the governor argues that Terri Schiavo's rights under the Florida Constitution are being protected, not violated.

Terri Schiavo went for six days without food and water after her husband Michael Schiavo removed her feeding tube. Florida lawmakers and Bush intervened, enacting a hastily drawn law that allowed the governor to order the feeding tube be reinserted.

Michael Schiavo has challenging the constitutionality of the governor's action. He contends his wife had said she did not want to be kept alive artificially before she suffered severe brain damage in 1990. Doctors have ruled she has been in a persistent vegetative state since, but her parents believe she is aware of her surroundings and could be rehabilitated.

Bush's attorney Ken Connor said a jury has to establish what Terri Schiavo's wishes were before a court can decide whether her private health care wishes were violated.

George Felos, Michael Schiavo's attorney, could not immediately be reached for comment.

Everybody knows the bone scan results. Media has them. Docs have seen them. What's the point in selaing them now?

I had never thought of that. Must be some reason they want them sealed. I wonder if the scans that were made public could be used at all in court?

I just received an email saying that Terri is being sedated. Anybody know anything more about that? I mean, I'm quite sure the reason is to make her appear "vegetative." Just wonder if anybody has any more details.

Thank you No More Gore Anymore. I recognize CP has no real value on human life. It just hurt me terrible to see his comment to Cindydawg about her winking not being communication. You have to raise a handicapped child to fully comprehend. Our George communicates. OH NOT like our other children. He has NO words. He only has looks, and a few words that he can try and sign language.Yet, to us , he is valuable. Some day we will know just why God allowed him into our lives. For now, we just love and accept his gift to us. Himself.

BTW, is it true that Terri was dressed in hot winter clothes (TURTLENECK?? was it cords, for real??) while she was being dehydrated ever make it into the public eye? Here I was thinking 'at least' she's in a comfy soft nightgown.

Talk about unbelievable! That makes a LIE of Felos' so-called "peaceful death process" right there -- and I hope it can be used for Terri!. Who had the nerve to do that to Terri? Did that get reported to abuse hotline by someone w/firsthand knowledge?

This was a quick check before going to bed after an evening of cleaning the carpet w/Big Bertha ;o).

May angels seen and unseen continue to guard, protect, and strengthen Terri. Sleep well, Terri & all -- may God give us all peaceful rest and renewed minds, spirits, and bodies for tomorrow. I pray that hard hearts and closed minds will be touched -- so that all who are able to do good for Terri will finally DO it. In Jesus' Name, Amen.
