You are absolutely wrong. There are recess appointments for federal judges. We've even had recess appointments for the Supreme Court, and Clinton recessed a judge to the 4th Circuit.

Did you see Lindsey Graham in a press conference saying that Hatch and Leahy have some "bad blood" from "way back" and that they should "take it somewhere else and settle it?" No, I haven't seen any of the press conferences. Did you watch much of the "Graham and Coleman Show" last night? They were very good and repeated over and over that we have to fix this, that we have to find a way to continue. Unlike the hysterical dems, they were very reasoned and sounded sincere.

I don't get C-Span2, so I can't see what's going on. Are they voting for cloture on the other Judge now? Or was that last vote a twofer?

I spoke with Specter office yesterday. There is a real jerk who answers his phone. I can not stand her. She is always yelling and irrational, anyway she told me that we did not want to block the filabuster becasue it is the REpublicians who called for it. That is all she had to say on the matter. Santorium's guy, who I love, said he thought Specter was supportive because AS is actually on the Judicial committee. Whatever that means? I guess I will ahve to llok up the votes to get to the bottom of it re: Specter

The "nuclear option" is a rule change, disallowing the filibuster of judicial appointments. I take the "nuclear option" even more narrowly -- to be that rule cahnge, imposed via ruling from the Chair and Parliamentarian, based on a challenge by a signle Senator that the present rule is unconstitutional.
I think quite a few Senators would support a rule change in the context of a new Congressional Session.

Think of CLOTURE as ENDING DEBATE. That is it in a nutshell. Senators can debate forever unless 60 senators vote affirmative for CLOTURE.

I all confused this morning...
I don't think a rule change is the way to go either, though.
Dems will use it to their advantage too.
I think the message that needs to be sent is that this was WRONG and the future democrat candidates for Senate should promise not to use this tactic again. The only hope is to use this politically. Screwing around with the rules is only going to make it worse, IMO.

Byrd is one. He wants to assert his KKK priviledge if any more civil rights bills come up.He still could. The change would not apply to legislative matters--just confirmations.
