The Pubs made their mistake at the very first attempt to filibuster a Judicial nominee. At that time, they should have raised a point of order and the "chair" should have ruled the filibuster-er out of order and moved on with the regular vote.
By not stopping it then, the result has created a legal morass [a.k.a. more-ass]. Now, unless Frist has the cajones to do the nuclear option, the Dems will continue to block these and future nominees.
If they don't stop the filibustering now, the Pubs just need to hope that a SC vacancy doesn't occur until after 2004, or they will never get any other than a compromise SC nominee--approved by Daschle/HClinton and company.

Frist should continue this through Sat.... Great idea.
Better one yet (if they have the stomach for it), since Landrieu drew the line in the sand last night when she said the nominees will never get on the bench, Frist should go all out. Someone needs to break first. Let it be the dems. I liken it with a child having a temper tantrum. We can go longer than the dems even considered.
IF (and this is where the GOP needs to show their coolective 'nads) the GOP puts their money where their mouths are, they will say, yes, this is important, we know it is important and we are willing to stay here as lonjg as it takes for the dems to stop their tantrum.
Of course, the 12 GOP might count dem heads and say, "we can make it even steven."
But at least we will know who they are.

My kids are talking about it in their High School History class - they say it's rough, though. The teacher is a lib but the majority of the students lean right.
