I have no idea where the money went...But.. He should be held accountable for it's whereabouts: and if he can't, that is reason for dismissal of guardianship.

IS A GUARDIAN ACCOUNTABLE?

Yes. Guardians must be represented by an attorney who will serve as "attorney of record." Guardians are usually required to
furnish a bond and may be required to complete a court-approved training program. The Clerk of the Court reviews all annual
reports of guardians of the person and property and presents them to the court for approval. A guardian who does not properly
carry out his or her responsibilities may be removed.

What law was bypassed in their constitution?

Sucks, doesnt it?
This whole case reeks to high heaven, and I am appalled at the number of people on this forum, and in this country, who try to claim this "judge" is following the law, or is even remotely interested in justice, or the constitution of the State of Florida, or the USA.
They call me, and people like me, who are enraged by the conserted attempt to murder this woman with "law", and yet they would prosecute me if I neglected and tortured a pet rabbit with forced starvation intent.
I guess I am "just too emotional" about this "issue" to be counted.
I actually endured a 20 minute tirade from a neurotic raving idiot, screaming comments at work, that Jeb Bush has tried to set himself up as Imperial Emporor, and has single handedly overruled the Supreme Court.
Were you aware that a certain segment of our society thinks that lawyers and judges and courts are pure and saintly, and only concerned with absolute justice?
I am scared.
Locked and loaded.

Following the money
The jury responded to his protestations of love and awarded $1.2 million to Terri for her medical and nursing expenses and $630,000 to Schiavo for loss of spouse. She also received a further $250,000 settlement in a case filed on her behalf against another doctor. After the attorneys received their cut, Terri was left with $700,000 and Schiavo with $300,000. Her share of the settlement was placed in a trust fund and invested in blue chip stocks, U.S. Treasury bonds and a money market account. It was to be managed by a bank and guarded by the court. In April 1993 her assets were valued at $776,254.
Her trust fund remained relatively intact until 1997, when Schiavo hired Felos and others began – with court approval – to dip into Terri's trust fund. Most of it went for legal costs.
According to the St. Petersburg Times, which investigated the matter in June 2001, by April 1998, her money was down to $713,825.
At Schiavo's request, Greer ordered all financial billings sealed, but payments are public record. The SP Times estimated that almost half the trust fund was gone, with only $350,000 remaining.
Greer later approved a payment of $45,007 to Felos, covering a five-month period ending February 2002. Including that payment, Felos had by February 2002, billed for $352,211 from Terri's fund. Other lawyers, too, helped drain the account – in particular, Deborah Bushnell, who received just under $50,000 between September 1993 and September 2001.
It's not certain how much of the money intended for Terri's rehabilitation remains. Felos told the Philadelphia Intelligencer that a few months ago only $50,000 was left. He said the money ran out last July and he hasn't been paid since. Terri's medical care at the Woodside Facility is now paid for with federal tax dollars through Medicaid, he said.
Court records show Felos' fees came to about $400,000, according to the Philadelphia Intelligencer.

Are annual reports a matter of public record, Snykerz?

"How much of The Bill of Rights & States' Rights are we going to trash to save Terri? Have emotions ruled over logic? (In my case, they have.) Do we want to set a precedent that can be used by other states' to bypass their constitutions in the future?"

I disagree with the premise. The lawmakers set the laws, not some judge. There were plenty of violations of Federal law by the husband and attorney. This attorney has been paid over $500,000 from Terri's money, which was suppose to go for her rehabilitation.

You need to read Chris Ferrara's Legal Brief for Terri in the first post on this thread:

THE FIGHT TO SAVE TERRI SCHIAVO - Chris Ferrara's Legal Brief for Terri
http://www.freerepublic.com/focus/f-news/1006586/posts

It is in pdf format and 27 double spaced pages, but it lays out how her husband and lawyer have conspired to violate Terri's rights under the 1st, 5th, and 14th admendment.

You also out in Felos' quote:
"It is so repugnant to so many provisions of Florida's constitution, we are all certain that it will be overturned," said George Felos, attorney for Michael Schiavo.

I wouldn't put much stock in what Felos says:
Read post 149 on this thread:
URGENT - ACTION NEEDED AT ONCE for Terri Schiavo
http://www.freerepublic.com/focus/f-news/1006292/posts
Here's part of it:

"On pages 181-182 of his book, Felos claims that merely by visualizing a plane crash during a flight he was taking back to Florida, he caused the plane to begin to crash and that God spoke to him at that moment to warn him: 'Be careful what you think. You are more powerful than you realize'.....'I was startled, humbled, and blessed by God's admonishment.'"

Attorney George Felos believes God speaks to him and that God has told him he is a powerful man. Powerful enough to crash an airplane merely by thinking of it. Attorney Felos, prepare to be truly admonished. Only this time it won't be by the little voices that speak in your head.

-------
Read the whole post and I think it is obvious the man is not playing with a full deck.

But, you see, it was unconstitutional. Florida has that right-to-die law & we pressured them to override it.

It's just too bad that the BIG BUSH (Dubya) and Tom Ridge can't add the Death Cult to the radical Muslims in the War on Terror. (What they are doing certainly IS terror for Terri and those like her.) Then we could just send Michael Schiavo, Geroge Felos and Judge Greer to GITMO.
In the meantime I still think there is enough non terror laws we could have these people ARRESTED on. (Illegal admittance to a hospice, conflict of interest, attempted murder and conspiracy to commit murder.)
I would also like to point out that anyone in Florida who is FReeping on the Terri threads and KNOWS that a crime is going on here can make a CITIZEN'S ARREST of these characters if no one in authority is interested in doing so. This may open you up to one HUMONGOUS lawsuit but in the final annalysis it may be the ONLY way to get Terri's REAL guardianship changed to her parents at this point.

Michael Schiavo
‘You Seek a Great Fortune’

Letting loose the children to the graveyard, she becomes
A bog filled with mosaic women, tiny-breasted, lithe,
A place to recite the alphabet backwards, forwards -- again,
Meaning now a pauper to the Creole at the bottom of the stairs.

Of our scrupulous testing, which never ceases to condemn me:
Is a high song, the chorale majestics of the crossroads
Closed on Sunday, “the good day” to be closed,
Or a page from a burgundy book taken to the Restaurant
Poetry and wolfed, but not the kind you think of, the word uttered “with”
On a stage propped against the leeward side of a hogback.

“The hollyhocks in the bee glade.” These words. These words
Descending upon every fatal ear, which is every ear, which is
The most annoying part of all this. Apologies to our tenants:
We’re making duplicate keys. Be patient. You’ll soon be in.

Because it was court ordered. Our fundamental rights are quite clear in the Constitution and Bill of Rights. We have STATES' rights, over and above the dictates of the federal government.

Re searching for business licenses and such, has anyone seen the name of the "fiance's" mother, who was standing guard at the hospice? I at first thought she was Michael's mother, but later was horrified to learn she was actually Jodi's mother. Brrrrrr! Has anybody been able to research that angle?

(Don't ask me why I'm still awake!)

5) Why is medicaid paying for Terri, someone who is not certified Terminally Ill to be kept in a hospice? When her husband drives a recent model Mercedes, owns a home with a pool, has an insurance corporation, and earns good income?

...and wears expensive suits. Has anyone else noticed that?

The Right-to-Die law. Every state can make their own laws in such matters. Oregon has allowed it, but Michigan outlawed assisted suicide (Kervorikan).

Anybody---
Have the Schindlers ever offered a deal to the court, for example seeking temporary guardianship, for 6 or 12 months, with a rehabilitation plan and all; and if no positive results in therapy occur, they'll relent?
It's a desperate sort of deal, but MS wouldn't be able to answer it and he might be tempted by the prospect of having them off his back. Plus if he's so d----d sure she's pvs, what's he got to lose?

There you go again ~ bringing up that fine point:

>>federal tax dollars through Medicaid<<

Strange, if tax dollars have been paying her bills since July, and she just was placed on Medicaid, according to the esteemed attorney, how were the expenses covered?

Can you say FEDERAL AUDIT?

(Congratulations on that post!)

So every new law that is passed, every modification that isn't specifically in the constitution is unconstitutional? Judges do this all the time. It's all a matter of who interprets don't you think?
