Gotcha.

You could say the exact same thing about Christopher Reeves, Stephen Hawking, and countless others.
A half century ago, half a world away, that mindset took root.
The world is still recovering. At least, it WAS recovering until "involunatary assisted suicide" became popular.

The judge has never been face-to-face with this woman so he couldn't have even tried asking to get any kind of response.

Can the legislature act quickly enough to change the law? Schiavo's family have had 13 years to appeal to them to do so. Since they have not, I have to assume that they never wanted to in the first place. And its a little late now.

Yes, I know the argument about living wills and how they are so important. However, not having the answer to that question truly does call into question what her wishes are.

You opined, Amazing how FReepers can argue for limited government and state sovereignty until either (a) the cows come home, or (b) they don't like the result...and then they demand expansive government. We freepers don't seem to be your sort of people, do we? Will you continue to bless us with your condescension? You and Dave S., strela and others of your disruptive ilk make a team of it.

"Some people around FR seem to have made up their own ping rules that require you to ping them if you mention them." That's nothing. Last night another troll emailed me TWICE to forbid me to post in threads she's active in.
I told her where she could stick that idea, and forbid her to ever mail me again.

I haven't heard of judges routinely visiting with litigants in the hospital.
Or, perhaps the answer to that is even more simple... the lawsuits involve the State of Florida, Schiavo, and Terri's parents... Terri Schiavo is the interested party in all of these suits, but she isn't actually bringing the suits to court. I wonder if she should have been used as a character witness?
Are the Schindler's lawyers well-respected in Florida?

I am not saying that! I think she wants to live... go back and read my posts.
However, I do suspect that Michael Schiavo would NEVER want that question asked... he wouldn't like the answer!

"UNLESS the law in the state of Florida supercedes that assumption. And I believe that it has in this case. The crux of this entire argument rests with the state of Florida and their policies on terminally ill/non-responsive patients." The NSDAP would have loved your brand of logic.

Other than the fact that the arguments have great internal weight of their own you are correct.Thank you.
Do you think, truly, that this woman's constitutional rights are not being grossly violated?
They are. But the Schindlers' attorneys aren't arguing in terms of Terri's constitutional rights, but in terms of how there's some legal mumbo-jumbo that will let them revoke Michael Schiavo's guardianship--which is not the case. That's why I'm getting suspicious of the motives of the attorneys.
Pretty oblique commentary there. But hardly surprising since you know darn well that I'm not arguing for expansive government, I'm arging for someone to have the guts to protect one poor, defenseless woman from a bunch of murderous ghouls.
You're arguing that Jeb Bush must ignore his legal counsel, put his subordinates at risk of criminal prosecution, and ignore the laws of the state of Florida, instead of the Schindlers' attorney arguing from equity.
You don't want a governor. You want a man on horseback.
That will cut both ways.
Are you a ghoul, too? Or simply so much of a contrarian that you just have to jump into a situation like this and make a muck of things?
Nope. I'm just a guy pointing out that the Schindlers' legal team is throwing the case.
But that bothers you not at all.

Only someone with a Living Will, with a DNR clause, should have treatment withheld. I can't agree on that one. I believe that the default should be no treatment/heroic measures UNLESS a Living Will or other document is filed indicating otherwise. There are hardheads such as myself out there who don't want a physician to lay a hand on us unless we say its OK for them to do so.
Also, I have problems with the inherent premise that the government owes a supply of food and water to every person in the United States, and further believe that mindset to be a slippery slope and subject to gross abuse. But I think that's a question of semantics.
Of course, I disagree strongly with the premise that food and water is "medical treatment".
It requires surgery to administer the portal for the food and water in the case of a non-responsive patient. The very definition of "medical treatment."

Legally, Michael is Terri.
He speaks for her. The court considers his words to be hers.
It's sick, isn't it.
