Updated 5:30 p.m. As of close of business on Monday, the Philadelphia Board of Elections had received petitions from 74 (out of more than 1,600) divisions.
Updated 3:45 p.m. Jill Stein officially filed a lawsuit in a bid to force all of Pennsylvanias votes to be recounted.
Jill Steins effort to recount presidential votes in three swing states already appears to be sputtering in Philadelphia.
While Stein, a former presidential candidate, has raised millions of dollars and filed for a recount in Wisconsin, the process in Pennsylvania is much more complicated. Candidates cannot file for a recount themselves. Instead, they either have to go to court and attempt to prove widespread voter fraud (theres no evidence of that at this point) or organize a voter-initiated recount effort.
Steins team is going for the latter, asking for thousands of volunteers across Pennsylvania to mobilize. For a voting division also known as a precinct to be recounted, three voters from that division must sign and file an affidavit.
As of noon Monday, the Philadelphia city Board of Elections had received petitions for 35 of the 1,686 voting divisions in Philadelphia, according to City Commissioner Al Schmidt. By 5:30 p.m., that number was 74 about 4 percent of the the citys total divisions.
Stein needed more than 5,000 people in Philadelphia alone to sign petitions to file for a recount and would have had to mobilize about 30,000 people statewide to get a full recount going in Pennsylvania. She contends that though her campaign is targeting recounts in Wisconsin, Pennsylvania and Michigan, it is not coordinating with the campaign of Hillary Clinton, who lost all three of those states to President-elect Donald Trump. The Green Party candidate has so far raised nearly $7 million to spearhead the recount.
Wanda Murren, a spokeswoman for the Pennsylvania Department of State, said in a statement Monday afternoon that the state is working to gather information from the 67 counties regarding their progress in certifying election returns. She said some counties have already certified their elections, therefore closing the five-day window to petition at the county level for a recount.
The Department of State is aware of petitions for a recount being filed in Berks, Bucks, Centre, Montgomery and Philadelphia counties, but isnt aware of how many were filed in each county.
Schmidt noted the county Board of Elections is required to audit 2 percent of voting machines following the election anyway, according to the Pennsylvania elections code. That means after each election is wrapped up, officials randomly audit voting machines to ensure the number of votes cast matches the number of electronic results in the central tabulation system.
For today, the county Board of Elections is in frequent contact with the Pennsylvania Department of State, which is expected to release a guidance to county officials today with instructions on how to move forward in recounting divisions where affidavits were filed. Schmidt said it remains a busy time for the county. Schmidt said that in the weeks after the election, the process of counting provisional ballots and verifying results continues.
The deadline for voters to file for a recount is the end of the day today.
Meanwhile, officials in Allegheny County have said they will delay certifying their election results as activists are filing petitions seeking a recount.
This story was updated to include a statement from the Department of State.
At this point what would you have them do? There are laws in place to allow recounts. So far Stein has been doing what the law allows as far as filing suit today. Today isn’t the day to fight. The day to fight is when it goes to court and by law both sides are allowed to be heard. Just because Trump hasn’t made a stink doesn’t mean they are not ALL over this behind the scenes. Remember who he just beat....EVERYBODY. Relax.
Yes that is what she did at 3:45 this afternoon.
Nothing is illegal until Trump is President, and that's what they are trying to prevent.
...This an attempted coup by soros....
He pulled off an actual Coup in Ukraine.
A Democrat Coup d’etat will not be tolerated by half the citizens of the USA. And that means big trouble for the perpetrators.
“Yes that is what she did at 3:45 this afternoon.”
So she contested the election and the court already granted it?
Thank You for the info.
“Yes that is what she did at 3:45 this afternoon.”
So she contested the election and the court already granted it? They said there was a basis for determining the election was illegal? How? That’s what she had to make a prima facie case for? how could she possibly do that?
Those filing affidavits better be airtight. Perjury carries jail time.
It’s more like an attempted coup d’twat.
filing for a recount isn’t good enough. She was too late. She had to file a lawsuit saying the election itself was ILLEGAL and she had to state a prima facie case that it was. Then the court had to have a hearing on that issue and determine that, on it’s face, what she alleged showed that the election was ILLEGAL! How could she possibly do that?
.
On election night I watched FBC; Kennedy & The Boyz. It was the best coverage, and looking at the recount nonsense is much more in context, and exposed for how silly it is.
I just want to wish you well. The way you are frantically reposting the same stuff saying no one cares, the election is being stolen etc is in some ways not true. People do care, but you are not looking at the whole picture of what is going on and you have no clue if Trump and his people are doing anything behind the scenes. You give no credit to the fact Trump beat 16 Republicans and Hillary so he obviously knows how to handle things. I think you will cause yourself illness due to stress and likely won’t be on FR much longer so, I’m saying I wish you well.
they know it is extremely unlikely any of this comes to anything.
they are trying to get legal precedents, rulings, for future elections. they are trying to get things delayed by frivolous lawsuits.
If Hillary and Democrats want politics to become a “blood sport” then I hope it is their blood that gets spilled during the process. I am not threatening them with physical harm, just saying that if they want all out partisan politics, they should expect no quarter in return.
From Jill Stein's Twitter: Voters in 100 Pennsylvania precincts have submitted affidavits requesting a recount. Kickstart #Recount2016: https://t.co/NAN4Ryf6Pw
The election is illegal. Was there a pot referendum that passed in PA?
Yeah but that’s not good enough. A recount is different than contesting the election. She was too late to get a recount. She had to CONTEST the election as having been ILLEGAL and present that to a court. Then the court had to have a hearing and determine that she presented a case...ON IT’S FACE...that showed the election was illegal. Then the court had to rule that way. Was there a court ruling?
So, in order to petition to contest the election, it will require five PA voters to swear, under penalty of perjury, to facts that, on their face, establish that the election was illegal. If these petitioners have no facts establishing - on their face - that the election was illegal, there will be no contest. The prima facie case must be established before the Court of Common Pleas. Since there are no facts that establish that the election was illegal, anyone making such a petition should fail. And if they play fast and loose with the facts in their petition, they will also be guilty of perjury.
Additionally - wait for it Jill Stein - anyone who is suborning such perjury by fraudulently claiming they are raising funds for a "recount", when in reality they are raising funds for a voter-initiated contest, is guilty of conspiring to commit fraud upon the 2016 election process. Jill Stein knows that there are no facts establishing a prima facie case that the Presidential election in Pennsylvania was illegal.
"Section 1827. Interference with Primaries and Elections; Frauds; Conspiracy" states:
"If any person shall...conspire with others to commit any of the offenses herein mentioned, or in any manner to prevent a free and fair primary or election, he shall be guilty of a felony of the third degree, and, upon conviction thereof, shall be sentenced to pay a fine not exceeding fifteen thousand ($15,000) dollars, or to undergo an imprisonment of not more than seven (7) years, or both, in the discretion of the court."
One of the offenses "herein mentioned" in the Pennsylvania Election Code is perjury. Jill Stein should know that anyone swearing out a petition to contest this election based upon her statements and fund raising literature will be committing perjury. Conspiring to have them do so is a felony punishable by up to seven years in prison.
There will be no recount in Pennsylvania. There should be no election contest in Pennsylvania either. There are no facts that will support a prima facie case of illegality. Jill Stein should end this in a very public manner, return the funds collected for the fraudulent recount effort in Pennsylvania, and she should pray that the Commonwealth of Pennsylvania does not have a prosecutor with the spine to make a proper example of her.
