Court documents show parents, uncle had role in death
According to court records from the Magistrate court in Dona Ana County, here are the events that led up to the murder of 5-month old Brianna Lopez.
Wednesday, July 24, 2002 --
- Thursday night, July 18th, at 6 p.m., Andy Walters stopped to buy a case of beer, and headed home to 5243 Comanche Trail in Las Cruces.
- Three people-- Walters, 21, Stephanie Lopez, 19, and her twin brother Steven Lopez, 19, drink through the evening.
- Stephanie went to bed after about three beers. According to court documents, Andy Walters and Steven Lopez admitted to playing with Stephanie and Walters's 5-month old daughter, Brianna.
- Police records show that Walters and Lopez threw the child into the air, causing her to hit her head on the ceiling 3 times, then dropped her twice on the floor.
- Andy Walters told investigators that Brianna was conscious and crying.
- At around 12:30 a.m., Friday morning, Andy Walters fell asleep not knowing where Brianna was.
- At three in the morning, Walters says he awoke to find Brianna on the floor near the bed. He said he wrapped her in a blanket and put her in a bouncer.
- By 7 a.m., Brianna needed a diaper change. Stephanie Lopez asked about the bruises on Brianna, and according to court documents, Walters admitted that he and Steven Lopez "played a little rough with her".
- Walters changed the diaper and took a baby wipe, wrapped it around his index finger and inserted it into brianna's anus.
- The complaint also states Andy Walters admitted he bit Brianna on several occasions, but he told Dona Ana County Sheriff's Deputies he is not not the only family member to bite Brianna.
- Walters also told authorites that Stephanie Lopez pinched and threw Brianna out of frustration.
- The uncle, Steven Lopez, admits to throwing Brianna in the air and not catching her. Steven Lopez claims to have drunk ten beers the previous night.
- During his interview with Sheriff's Deputies, Steven Lopez admitted to having sex with Brianna Lopez.
- By 10 a.m., July 19th, Stephanie Lopez checks on her daughter, notices Brianna is not breathing, and she calls 9-1-1.
- 11:10 am, Friday July 19th, five month old Brianna Lopez died at Memorial Medical Center in Las Cruces.
- Autopsy results show Brianna Lopez had 11 bite marks on her body, broken ribs, skull fractures, bleeding of the optic nerves and brain swelling.

Stop being a jerk. There is nothing funny about this. And alcohol is the root cause of this. Worst drug there is because it is legal and cheap. But outlawing it is no solution.

In the latter case you must rely on witnesses or snitches or what evidence can be gathered by detectives. So, if Brianna WERE alive, and WERE old enough to testify, I assume the death penalty WOULD be fine in this case?

BTW, I just heard on the radio that Avila's attorney from his first case said that he doubts whether Avila will be able to get a fair trial. "What with the police going around saying they're 100% sure they have their man"......

I could give him a fair trial. In 1970 I sat on a jury of a capital case in Texas. That person got a fair trial. I have sat on a couple dozen courts martial. All of those people got a fair trial, too. Really.

Please tell me these devoids are in jail. In jail no bail
Sheriff's deputies say a total of nine people lived at the home in Las Cruces where the abuse allegedly happened.
Any of those nine who knew of the abuse and did not protect this baby are guilty, too. They should have stomped all over the parents perceived "rights" and saved this child.

I don't know what to feel right now. The signs of a Clinton generation of "who cares?" is showing its signs. I want all 3 involved dead or locked away for the rest of their lives. No but...but...but...it was a ...no...you lost your chance to live. Sorry. I am just sick.

As a society, we DO need to kill these people . The good people, the decent people, need to take it back before it's taken from us. Do I necessarily approve of public execution? Probably not, but that's not on this thread, not yet...(I think).No "society" can claim me Gramma. I don't run with the herd. And that's been a good thing as some people have been spared unwarranted abuse for my remaining independent of the herd mentality and not participating in or thwarting some herd action.

So, if Brianna WERE alive, and WERE old enough to testify, I assume the death penalty WOULD be fine in this case?The problem is that there can be no law passed to cover this one case or some several cases that I or you are aware of. If we're going to pass laws emotionally on the basis of some few select incidents then we'll have to drop our opposition to gun control.

The only possibly good thing about the whole situation is that it happened in Texas, and not California.
Unfortunately my friend, this happened in southern New Mexico, not Texas. I'm concerned that this sicko will get maybe a couple of years, and then be released right back into society.

Sorry, but this occured in New Mexico where we don't have a death penalty worth a damn and "life" is only 30 years before you're eligible for parole.
Dona Ana county, figures. That's where a 100 was changed to 600 (it looked like a bad report card forgery) and gave the state to Gore in 2000. Well, this is one less DemocRAT voter on their rolls.
