Davis Excuse in Pledge Case Proves Outright False
Simon Provides Certified Mail Receipts Showing Davis Ignorance Claims Unfounded
RIVERSIDE - Governor Gray Davis' excuse regarding his failure to entered a defense in the recent Pledge of Allegiance lawsuit has proved outright false, gubernatorial candidate Bill Simon told a gathering of business leaders today.
On Thursday, after Simon blasted the governor for his failure to submit a legal defense on behalf of the state, Davis responded by saying he had not entered a defense because neither he nor Attorney General Bill Lockyer had been notified that the state was a defendant in the lawsuit, and quickly paraded the announcement that he would now submit a defense. [Sacramento Bee and Contra Costa Times - June 28, 2002]
But on March 8, 2000, the same day that Michael Newdow filed his court case challenging the Pledge of Allegiance, a summons to appear in court was sent by certified mail to Lockyer at the Department of Justice address advertised on his Web site, records show. The plaintiff, Newdow, filed on March 10, 2000 with the Eastern District Court in Sacramento the receipt of certified mail showing proof of service to Lockyer's office. On April 26, 2000, Newdow filed with the court clerk proof of receipt showing that the attorney general's office had received the service.
"Gray Davis now claims neither he nor his attorney general were served papers about the lawsuit," Simon said in remarks to the Riverside Lincoln Club. "But the U. S. Government, in courthouse documents and through certified mail, tells a different story. The plaintiff of the case is in possession of proof of service, demonstrating that the governor's lawyer, Bill Lockyer, did receive notice. The fact of the matter is that once again our governor is resorting to half-truths and deflection in order to mask his failure to act."
"Gray Davis' failures as governor continue to accumulate with each day he is in office," Simon said. "He failed to act in the energy crisis, in the budget crisis, to prevent offshore oil drilling, on the needs of California veterans, and now it is clear the governor failed to act in defending the Pledge of Allegiance. This list goes on and on. California just cannot afford this kind of failure."

Davis, I understand, announced the other day that Lockyer will appeal the Ninth Circuit's decision. Does he have any standing to appeal that decision when his government, as the Ninth Circuit's decision attests, took no stand in the Ninth Circuit's initial decision? Haven't he and his government already defaulted in the case, by that failure?

Are there civil penalties for ignoring a call for appearance at court...if you, me or joe citizen did this we would be in jail double quick.<p.
Also can't there be a filing of mandamus (sp) to force him to appear and do his job in this case?

I'm really looking forward to the day when we can say, proudly, GOVERNOR SIMON.
To: Inspectorette
I doubt that we'll see this in any of the California lamestream media, and even if they did cover it, he'll just deny that he knew about it, that it was handled at a lower staff level, blah, blah, blah. Right. About all I've seen so far are Davis attack ads on Bill Simon's business acumen (or lack thereof), and the media shrieking about how all California's problems are because of greedy Enron executives.
Considering the prevailing culture of victimology in California, I think Simon's chances are long indeed. That, and the fact that like most Republicans, he doesn't seen to have a clue about bare-knuckled alley fighting, unlike the Libs.

he doesn't seen to have a clue about bare-knuckled alley fighting I dunno.....his latest ads seem to be right on the money:
Time's Up
Maids
Receptionist
The rest of the ads may be found here.

Perhaps we need to make postcards that look like our currency. We can send Davis thousands of the postcards with comments such as: Gray, if I send you a couple thousand bucks, what will you do for me?

On the other hand, it's entirely possible Davis knew and is lying.Bingo! Especially, since he sought to speak for the AG.

Service of Summons by Certified Mail alone is NOT good service within the State of California. CCPs415.50
This would have required personal service on the "the clerk, secretary, presdient, presiding officer or other head of its governing body" (e.g.the A.G.)CCPs416.50, a very easy thing to do for anyone in Sacramento. They are not hard to find.
This does not mean that Davis is not a typical lying leftie for, of course, he is.

That's really great! Except this:
He failed to act ...to prevent offshore oil drilling
Huh? Sounds like score one for Davis. (The only one, but one all the same.)

Coming from you, Sauron, I'd have to say that that comment has the ring of authority.

I like 'em. I like all of 'em. Probably the elite media will label Simon a smear campaign artist and a hate monger, unwilling to run on the issues.
I like 'em anyway.

I haven't read any papers on that subject lately. I can tell you from my own observations that the pelicans have made a strong comeback over the past 20 years. Anacapa Island (actually three closely spaced islands) is not the only pelican breeding location. There are several others on the neighboring islands.
It seems to me that the pelican was doing just fine with the oil and tar seepage, as were all the other animals in the Channel area, for hundreds and thousands of years. In many ways the "natural" ecosystem included oil and tar.
What caused the problems with the pelicans shells or nesting sites, I am not sure. But I watch those pelicans at dusk, dive-bombing the breakers for fish, and all seems right with the world. Now, if we could just get rid of Davis!

Goodness, that's the first time I've seen those Davis commercials. They are hilarious. Thanks for the morning wake-up.
