Why does the article state that "life in prison" is the maximum penalty even though the murder occured in Texas? It doesn't meet the definition of capital murder under the Texas Penal Code, and that's the only murder that may be punished by the death penalty.

This story just makes my skin crawl. I can't get the picture out of my head of that poor man lodged in the windshield, pleading for help. And if she was drunk or stoned, that wears off, what is her excuse for after that? Ugh, this just makes me sick to my stomach.

My God. Can you imagine the outcry if the races had been reversed? Yes, and it is a shame that merchants of the race-hate industry such as Jesse Jackson and Al Sharpton would use such an incident to divide the country and line their own pockets.
But responding in a tit-for-tat manner only helps them in the long run. This woman deserves just punishment for what she did to another human being. Neither her race, nor the victim's, should have any bearing.

No, unfortunately Texas has gone the way of most states and abolished the electric chair. Being PC and all, we give them an injection - much the same as we do with our beloved animals when their time is up. It's gentler that way, doncha know....

Why does the article state that "life in prison" is the maximum penalty even though the murder occured in Texas Because to be capital murder there has to be an aggravating circumstance, for example, killing a child, police officer, fireman, multiple people in 1 transaction, etc...
Now killing in the same transaction as another felony is capital murder. I think they should charge her with the man's kidnapping (he was obviously taken against his will) and subsequent murder, making it a capital case.

This was a hate crime plain and simple and white people deserve exatly what they get for sitting on their behinds and not being counted.The state of Texas splashed James Byrds picture all over the world along with the rest of mainstream media.Maybe whites should take to the streets looting and burning.When is enough,enough!

This is such a horrific crime, I can't imagine her getting anything less than DEATH!
