Why does the article state that "life in prison" is the maximum penalty even though the murder occured in Texas Because to be capital murder there has to be an aggravating circumstance, for example, killing a child, police officer, fireman, multiple people in 1 transaction, etc...
Now killing in the same transaction as another felony is capital murder. I think they should charge her with the man's kidnapping (he was obviously taken against his will) and subsequent murder, making it a capital case.

Thanks for the explanation.

If the boyfriend was there while the victim was alive, the offenses include CONSPIRACY, which I believe would result in the possibility of the DEATH PENALTY for both the woman, her boyfriend, and anyone else that knew what was going on before the victim died.
Fry them all.

"Because to be capital murder there has to be an aggravating circumstance . . ."Would death by torture count? Bleeding to death while imprisoned by broken glass for two days would appear to be sufficiently hideous to merit a death penalty.

Don't you love how some people's lives are worth more because our taxes pay their salaries?

The attorney was saying that the man died after only three hours, instead of two days--as if this makes the crime any less heinous.
