Why does the article state that "life in prison" is the maximum penalty even though the murder occured in Texas? It doesn't meet the definition of capital murder under the Texas Penal Code, and that's the only murder that may be punished by the death penalty.

One would think this COULD be considered Capitol (sp?) Murder... The way I see it is that the reason she "let" him die is so she wouldn't get in trouble... In other words, she had something to gain by his death... which should, possibly, meet the definition of Capitol Murder... but I'm not a lawyer, so never mind...
